c;- Draft Sewer Use Ordinance: The Engineer shall prepare a Draft Sewer Use Ordinance to submit with the Plans and Specifications. d. Preliminary Plan of Operation: The Engineer shall prepare a Prel iminary PLtn of Operation to submit with the Plans and Specifications. General Representati on and Observati on Duri ng Constructi on: The Enqineer shall furnish general representation and observation of the work during the construction phase as follows: Assist in the award of construction contracts; pro..,i de the Owner wi th ten (lO) sets of bi ddi ng documents; rev; ew shop drawi ngs pursuant to the General Cond; t; ons of the Construction contract; make periodic (2 per month) visits to site by office staff; review such work of testing laboratories as may be required by the Owner; keep the laboratories as may be required by the Owner; keep the Owner informed of the progress of the work; issue all instructions of the Owner to Contractor; prepare change orders as required and review the application for payment submitted by the Contractor. The Engineer shall use reasonable diligence to detect defects and deficiencies in the work of Contractor and disapprove or reject work as failing to conform to the Contract Documents. Engineer shall not be responsible for the means, methods, techni ques, sequences or procedures of construction selected by Contractor or the safety precautions and programs incident to the work of the Contractor. Engineer shall not be responsible for the acts or omissions of any person, (except hi sown employees and agent) at the Proj ect site or otherwi se performi ng any of the work of the Project. e. f. Resident Representation During Construction: If requested by Owner, a Resident Project Representative will be furnished who will act as directed by the Engineer in order to provide more extensive representation at the Project site during the Constructi on Phase. The Owner shall advi se the Engi neer before the compl eti on of the preparati on of the Contract Documents if the Engineer is to provide this service. The duties and responsibilities and the limitations on the authority of the Resident Project Representative will be set forth in Attachment A which is to be identified, attached to and made a part of this Agreement. Construction layout will be provided as a part of Resident Project Representation. Through more extensive on-site observations of the work in progress and field checks of materials and equipment by the Resident Project Representative, the Engineer shall endeavor 2
