<br />the Engineer is to <br /> <br />submit <br /> <br />to <br /> <br />Owner <br /> <br />the <br /> <br />final <br /> <br />construction <br /> <br />contract <br /> <br />documents, <br /> <br />plans <br /> <br />and specifications) shall be extended by a like amount <br /> <br />of time. <br /> <br />ARTICLE 2 <br /> <br />THE OWNER1S RESPONSIBILITIES <br /> <br />2.1 <br /> <br />The Owner shall provide full information regarding requirements <br /> <br />for the project(s). <br /> <br />Such information may include a program, which <br /> <br />shall <br /> <br />set <br /> <br />forth <br /> <br />the <br /> <br />Owner's <br /> <br />design <br /> <br />objectives, <br /> <br />constraints <br /> <br />and criteria, <br /> <br />including <br /> <br />space <br /> <br />requirements <br /> <br />and <br /> <br />relationships, <br /> <br />flexibility <br /> <br />and <br /> <br />expandability, special equipment and systems and site requirements. <br /> <br />2.2 <br /> <br />If <br /> <br />the <br /> <br />Owner <br /> <br />provides <br /> <br />a <br /> <br />budget for the project(s) it shall <br /> <br />include <br /> <br />contingencies <br /> <br />for <br /> <br />bidding, <br /> <br />changes <br /> <br />in <br /> <br />the <br /> <br />Work <br /> <br />during <br /> <br />construction, <br /> <br />and other costs which are the responsibility of the Owner, <br /> <br />including those described in this Article 2 and <br /> <br />in <br /> <br />Subparagraph <br /> <br />3.1.2. <br /> <br />The Engineer shall accept the Owner's authorization to bid the project(s) <br /> <br />as <br /> <br />evidence <br /> <br />that <br /> <br />arrangements <br /> <br />exist <br /> <br />for fulfillment of the financial <br /> <br />obligations assumed by the Owner hereunder. <br /> <br />2.3 <br /> <br />The Director of Environment and Engineering <br /> <br />is <br /> <br />designated <br /> <br />as <br /> <br />Owner's <br /> <br />representative <br /> <br />and <br /> <br />is <br /> <br />authorized to act in the Owner's behalf <br /> <br />with respect <br /> <br />to <br /> <br />the <br /> <br />project(s). <br /> <br />The <br /> <br />Owner <br /> <br />and/or <br /> <br />such <br /> <br />authorized <br /> <br />representative <br /> <br />shall examine the documents submitted by the Engineer and <br /> <br />shall render responses pertaining thereto promptly and provide <br /> <br />Engineer <br /> <br />with <br /> <br />requested data or information in Ownerls possession relating to the <br /> <br />project(s). <br /> <br />2.4 <br /> <br />The <br /> <br />Owner <br /> <br />shall <br /> <br />provide <br /> <br />access <br /> <br />to <br /> <br />and <br /> <br />make all necessary <br /> <br />provisions for the Engineer to enter upon public and private property <br /> <br />as <br /> <br />required for the Engineer to perform its services under this Agreement. <br /> <br />2.5 <br /> <br />The <br /> <br />Owner <br /> <br />shall <br /> <br />furnish structural, mechanical, chemical and <br /> <br />other laboratory tests, inspections and reports as required by law or the <br /> <br />construction contract documents or as reasonably needed by the <br /> <br />Engineer. <br /> <br />The <br /> <br />Engineer <br /> <br />shall not be held responsible for its reliance on any such <br /> <br />information supplied by Owner provided that Engineer <br /> <br />does <br /> <br />not <br /> <br />know <br /> <br />or <br /> <br />reasonably <br /> <br />cannot be expected to know of any deficiency or error in such <br /> <br />information supplied by Owner. <br /> <br />2.6 <br /> <br />The Owner shall furnish all <br /> <br />legal, <br /> <br />accounting <br /> <br />and <br /> <br />insurance <br /> <br />counseling <br /> <br />services <br /> <br />as may be necessary at any time for the project(s), <br /> <br />including such auditing services <br /> <br />as the Owner <br /> <br />may require to <br /> <br />ascertain <br /> <br />-9- <br />
