<br />other persons performing any of the Work, or for the failure <br /> <br />of <br /> <br />any <br /> <br />of <br /> <br />them <br /> <br />to <br /> <br />carry out the Work in accordance with the construction contract <br /> <br />documents unless such acts or omissions are <br /> <br />due <br /> <br />to <br /> <br />negligence <br /> <br />of <br /> <br />the <br /> <br />Engineer or are acts or omissions under the Engineer's control. <br /> <br />However, <br /> <br />Engineer <br /> <br />shall <br /> <br />exercise <br /> <br />its authority on behalf of Owner in accordance <br /> <br />ìlerewi th and particularly during <br /> <br />the <br /> <br />construction <br /> <br />phase <br /> <br />so <br /> <br />that <br /> <br />the <br /> <br />means, <br /> <br />methods, <br /> <br />techniques, <br /> <br />sequences <br /> <br />and <br /> <br />procedures of construction <br /> <br />result in a project(s) cômpleted <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />construction <br /> <br />contract documents, and during said phase should Engineer become aware of <br /> <br />Contractor's <br /> <br />utilization of means, methods, techniques, sequences and/or <br /> <br />procedures of construction which, in Engineer's opinion, will not <br /> <br />result <br /> <br />in <br /> <br />completion <br /> <br />of <br /> <br />i:he <br /> <br />project(s) <br /> <br />in <br /> <br />accordance with the construction <br /> <br />contract documents or which are unsafe, <br /> <br />Engineer <br /> <br />shall <br /> <br />immediately <br /> <br />so <br /> <br />inform <br /> <br />Owner <br /> <br />and <br /> <br />shall take all necessary action which the Engineer is <br /> <br />authorized under this Agreement to take to correct the matter. <br /> <br />In <br /> <br />such <br /> <br />situations, <br /> <br />the <br /> <br />Engineer <br /> <br />shall have the right and power to immediately <br /> <br />cease t.he work by Contractor on the project( s) . <br /> <br />1.5.6 <br /> <br />The Engineer shall <br /> <br />at <br /> <br />all <br /> <br />times <br /> <br />have <br /> <br />access <br /> <br />to <br /> <br />the <br /> <br />vvork <br /> <br />wherever it is in preparation or progress. <br /> <br />1.5.7 <br /> <br />The <br /> <br />Engineer <br /> <br />shall <br /> <br />determine <br /> <br />the <br /> <br />amounts <br /> <br />owing <br /> <br />to <br /> <br />the <br /> <br />Contractor <br /> <br />based <br /> <br />on <br /> <br />its <br /> <br />on-site <br /> <br />professional <br /> <br />inspections <br /> <br />and <br /> <br />on <br /> <br />evaluations <br /> <br />of <br /> <br />t.he <br /> <br />Contractor's <br /> <br />Applications <br /> <br />for <br /> <br />Payment <br /> <br />including <br /> <br />comparisons of Contractor's monthly cost reports <br /> <br />with <br /> <br />his <br /> <br />i\pplications <br /> <br />for <br /> <br />payment, and shall make recommendations cor Payment in such amounts, <br /> <br />as provided in the construction contract documents, or <br /> <br />take <br /> <br />such <br /> <br />other <br /> <br />appropriate action which the Engineer deems necessary. <br /> <br />1.5.8 <br /> <br />Re c o:m..rn end a tions <br /> <br />for <br /> <br />Payment shall constitute a representation <br /> <br />by Engineer to the Owner, based on the <br /> <br />Engineer's <br /> <br />on-site <br /> <br />professional <br /> <br />inspections at the site as provided in Subparagraph 1.5.4 and on the data <br /> <br />comprising <br /> <br />the <br /> <br />Contractor's <br /> <br />Application for Payment, that the Work has <br /> <br />progresseëi to the point indicated¡ that, to the best <br /> <br />of <br /> <br />the <br /> <br />Engineer's <br /> <br />çnowledge, <br /> <br />information <br /> <br />and <br /> <br />belief, <br /> <br />the <br /> <br />quality <br /> <br />of <br /> <br />tÌ1e <br /> <br />Hork <br /> <br />is in <br /> <br />~cceptable conformance with the construction contract documents <br /> <br />(subject <br /> <br />to <br /> <br />an <br /> <br />evaluation <br /> <br />of <br /> <br />the <br /> <br />\'¡ork <br /> <br />for <br /> <br />conformance with the construction <br /> <br />contract documents upon Substantial Completion, subject to the results of <br /> <br />any subsequent tests required by <br /> <br />or <br /> <br />performed <br /> <br />under <br /> <br />the <br /> <br />construction <br /> <br />-5- <br />
