<br />contract documents, subject to minor <br /> <br />variations <br /> <br />from <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents <br /> <br />correctable <br /> <br />prior to completion, and subject to any <br /> <br />specific qualifications stated in the Certificate for Payment); and <br /> <br />that <br /> <br />the <br /> <br />Contractor is entitled to payment in the amount certified. <br /> <br />However, <br /> <br />the issuance of a Certificate for Payment shall not be <br /> <br />a <br /> <br />representation <br /> <br />that <br /> <br />the Engineer has made any examination to ascertain how and for what <br /> <br />purpose the Contractor has <br /> <br />used <br /> <br />the <br /> <br />monies <br /> <br />paid <br /> <br />on <br /> <br />account <br /> <br />of <br /> <br />the <br /> <br />Contract Sum. <br /> <br />1.5.9 <br /> <br />The Engineer shall have authori-ty to reject <br /> <br />conform <br /> <br />to <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents. <br /> <br />Work which does not <br />Whenever, in the <br />advisable for the <br /> <br />Engineerts reasonable opinion, it <br /> <br />is <br /> <br />necessary <br /> <br />or <br /> <br />proper <br /> <br />implementation <br /> <br />of <br /> <br />the <br /> <br />intent <br /> <br />of <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents, and with the approval of the Owner, <br /> <br />the <br /> <br />Engineer <br /> <br />will <br /> <br />have <br /> <br />authority <br /> <br />to <br /> <br />require <br /> <br />special <br /> <br />inspection <br /> <br />or <br /> <br />testing <br /> <br />of <br /> <br />the Work in <br /> <br />accordance with the provisions of the <br /> <br />construction <br /> <br />contract <br /> <br />documents, <br /> <br />whether or not such Work be then fabricated, installed or completed. <br /> <br />The <br /> <br />Engineer <br /> <br />shall <br /> <br />monitor <br /> <br />and <br /> <br />review the work and results of all testing <br /> <br />laboratories as required by Owner. <br /> <br />1. 5 .10 <br /> <br />The Engineer shall review and make all decisions regarding <br /> <br />the <br /> <br />approval <br /> <br />or <br /> <br />taking <br /> <br />of <br /> <br />other <br /> <br />appropriate action upon the Contractor's <br /> <br />submittals, including but not limited to, Shop Drawings, Product Data and <br /> <br />Samples, Schedule of Values and progress schedule. <br /> <br />Such action shall <br /> <br />be <br /> <br />taken with reasonable promptness, but generally not to exceed fi fteen <br />(15) days or such period of time which will not cause delay of the <br />project(s). <br />1.5.11 The Engineer shall prepare Change Orders for the Owner's <br /> <br />approval and execution <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents, <br /> <br />but <br /> <br />shall not issue change orders not previously approved in <br /> <br />writing by OWner, and no course of conduct on the <br /> <br />part <br /> <br />of <br /> <br />Engineer <br /> <br />or <br /> <br />OWner <br /> <br />shall <br /> <br />act <br /> <br />to <br /> <br />amend, waive or alter this provision. <br /> <br />If additive <br /> <br />Change Orders are required as a result of any error(s) and/or omission(s) <br /> <br />)f Engineer as determined by a third party selected by Owner and Engineer, <br /> <br />J!:ngineer shall, within thirty (30) days of receipt of an invoice therefor <br /> <br /> <br />from Owner, reimburse Owner in an amount equal to ten percent (10%) of the <br /> <br />amount of the additive change order. <br /> <br />-6- <br />
