<br />1.5.12 <br /> <br />The <br /> <br />Engineer <br /> <br />shall <br /> <br />conduct <br /> <br />professional <br /> <br />inspections <br /> <br />to <br /> <br />determine <br /> <br />the <br /> <br />Dates <br /> <br />of Substantial Completion and final completion, to <br /> <br />evaluate the <br /> <br />Work <br /> <br />for <br /> <br />acceptable <br /> <br />conformance <br /> <br />with <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents <br /> <br />and <br /> <br />in <br /> <br />light <br /> <br />of any subsequent tests performed as <br /> <br />described in Section 1.5.8 hereof, to verify that <br /> <br />any <br /> <br />minor <br /> <br />deviations <br /> <br />from <br /> <br />the <br /> <br />construction <br /> <br />contract documents as described in Section 1.5.8 <br /> <br />hereof have <br /> <br />been <br /> <br />corrected <br /> <br />and <br /> <br />that <br /> <br />the <br /> <br />reasons <br /> <br />for <br /> <br />any <br /> <br />specific <br /> <br />qualifications <br /> <br />in <br /> <br />any <br /> <br />and <br /> <br />all <br /> <br />previous <br /> <br />Certificates <br /> <br />For Payment as <br /> <br />described in Section 1.5.8 hereof are <br /> <br />either <br /> <br />no <br /> <br />longer <br /> <br />valid <br /> <br />or <br /> <br />the <br /> <br />condition(s} <br /> <br />and/or <br /> <br />problem(s} <br /> <br />have <br /> <br />been corrected¡ shall receive and <br /> <br />review <br /> <br />written <br /> <br />warranties <br /> <br />and <br /> <br />related <br /> <br />documents <br /> <br />required <br /> <br />by <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents <br /> <br />and assembled by the Contractori shall <br /> <br />issue a final Certificate for Payment or take other <br /> <br />appropriate <br /> <br />action¡ <br /> <br />and <br /> <br />shall <br /> <br />make <br /> <br />a <br /> <br />written <br /> <br />reconunendation <br /> <br />to <br /> <br />Owner regarding Owner's <br /> <br />acceptance of the Project. <br /> <br />1.5.13 <br /> <br />The extent of the duties, responsibilities and <br /> <br />limitations <br /> <br />of <br /> <br />authority <br /> <br />of <br /> <br />the <br /> <br />Engineer <br /> <br />as <br /> <br />the <br /> <br />Owner's <br /> <br />representative <br /> <br />during <br /> <br />construction shall not be modified or <br /> <br />extended <br /> <br />after <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents have been authorized by Owner to be competitively bid <br /> <br />without written consent of the Owner and the Engineer and with notice <br /> <br />to <br /> <br />the Contractor. <br /> <br />1. 5 .14 <br /> <br />The <br /> <br />Engineer <br /> <br />shall <br /> <br />prepare <br /> <br />and submit to the Owner a set of <br /> <br />reproducible record drawings showing significant changes in the Work made <br /> <br />during the construction phase. <br /> <br />1.5.15 <br /> <br />In the event of any arbitration proceeding <br /> <br />as provided in <br /> <br />the construction contract documents, the Engineer may be made a party <br /> <br />thereto at the request of either Owner or Contractor. <br /> <br />Any work per- <br /> <br />formed by Engineer during arbitration proceedings <br /> <br />shall be compensated <br /> <br />as additional services under Section 1.6. <br /> <br />1.5.16 <br /> <br />Basic <br /> <br />horizontal <br /> <br />and <br /> <br />vertical <br /> <br />control <br /> <br />points <br /> <br />will <br /> <br />be <br /> <br />established by the Engineer for the Owner's benefit. <br /> <br />All other surveying <br /> <br />during this phase shall be the responsibility of the Contractor. <br /> <br />1.6 <br /> <br />ADDITIONAL SERVICES <br /> <br />For the purposes of this Contract, additional services will <br /> <br />be <br /> <br />considered to be all services not included in the basic <br />contracted services as identified in Article 1, excluding <br />Sections 1.6 and.l.7. Additional services shall be provided if <br /> <br />authorized or confirmed in writing by the Owner as provided <br /> <br />in <br /> <br />-7- <br />
