PATTERSON; MAX~';¡ELL WATER SUPPLY CORPORATION, EASEMENT HOLDER¡ SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT, THE COUNTY OF HAYS, AND THE STATE OF TEXAS, TAXING AUTHORITIES HAYS COUNTY, TEXAS PLAINTIFF'S STATEMENT OR PETITION IN EMINENT DOMAIN TO THE HONORABLE JUDG~ OF SAID COURT: Now comes The City of San Marcos, Texas, a municipal corporation, situated in Hays County, Texas, and files this its original statement or petition for condemnation of land and interests or rights pertaining thereto and would respectfully show the following: 1. That the City of San Marcos, Hays County, Texas, hereinafter called Plaintiff, is a municipal corporation, created by and operating pursuant to Article 1, Section 17, of the Constitution of the State of Texas, and Article 3264 et seq., Vernon's Annotated Texas Statutes, and, as such, has the power of eminent domain for the acquisition of fee simple title to the property described in Paragraph II hereof and an easement interest in the property described in Paragraph IV hereof for the installation and maintenance of electronic and electrical equipment and structures to provide precision approach procedures to aircraft utilizing Runway 12 of the municipal airport of Plaintiff and for the establishment, creation and maintenance of a clear zone to prov it~ e control and rights to the air space within the approach surface to Runway 12 of said municipal airport of Plaintiff.
