<br /> -3- <br /> THENCE South 44 ° 58' 51" East a distance of 102.90 feet to a <br /> point which is marked with an aluminum capped iron rod on the <br /> said north right of way line; <br /> THENCE South 53° 05' 00" West along the said right of way line <br /> a distance of 202.00 feet to the point of beginning. <br /> III. <br /> That said fee simple title is required for a public purpose, <br />to-wi t: for the installation and maintenance of electronic and <br />electrical equipment and structures to provide precision approach <br />procedures to aircraft utilizing Runway 12 of the municipal airport of <br />Plaintiff. Plaintiff would further show that the interest in land <br />referred to in Paragraph II will be used for a purpose for which <br />Plaintiff possesses the power of eminent domain. <br /> IV. <br /> That Plaintiff, acting through its City Council by resolution <br />adopted on March 5, 1984, a certified copy of which is attached hereto <br />and incorporated herein for all intents and purposes, has heretofore <br />found and determined that it is necessary to acquire for a public <br />purpose, an easement interest in and to a 45.762 acre tract of land out <br />of and a part of that 132.65 acre tract out of the T. G. McGehee Survey <br />in Hays County, Texas, said 45.762 acre tract being more particularly <br />described by metes and bounds as follows, to-wit: <br /> A parcel of land containing 48.685 acres out of that l32.65 <br /> acres out of the T. G. McGehee Survey, Hays County, Texas, <br /> conveyed by that deed of partition from the estates of Mrs. <br /> Mary Patterson and her husband, W. ~'l. Patterson, to Ohren R. <br /> Patterson which was recorded in Volume 117, Pages 289-298 of <br /> the deed records of said county; this 48.685 acre parcel is <br /> more particularly described by metes and bounds as follows: <br /> BEGINNING at the south corner of the parcel, which is marked <br /> with an aluminum capped steel rod on the north right of way <br /> line of State Highway 21, opposite the highway centerline <br /> station of 136 + 82.77; <br /> THENCE North 53° 30' 42" West a distance of 1292.04 feet to <br /> the west corner of the parcel, which is marked with an <br /> aluminum capped steel rod; <br /> THENCE North 45° 01' 09" East a distance of 1750.00 feet to <br /> the north corner of -the parcel, which is marked with an <br /> aluminum capped steel rod; <br /> THENCE South 36 ° 27' 00" East a distance of 1483.76 feet to <br /> the east corner of the parcel, which is marked with an <br /> aluminum capped steel rod on the said north right of way line, <br /> opposite the highway centerline station of 150 + 34.37; <br />
