<br /> LESSEES AND THEIR OPERATIONS <br />Chandelle A y_.l<?j:_i.Qfi <br /> <br /> Cnandelle Aviation <br /> Chandelle, through its president, John Stokes, leases a city- <br /> owned hangar. Chandelle allows a non-profit organization, the <br /> Confecerate Air Force, to use the hangar for restoration and <br /> maintenance of Norld \var II vinta.ge aircraft. The CAF attracts <br /> a number of tourists and visitors to the airport, which in turn <br /> generates interest in and brings attention to ~he airport. The <br /> building is in extremely poor condition. The City Building Inspector <br /> inspected the building in March and reports that the five major <br /> trusses are suffering from severe deterioration and without the <br /> support of shoring poles, most of the trusses would collapse. <br /> Tnere is rotten roof decking in many places as well as sagging <br /> which the inspector feels could cause failure of the trusses if <br /> water were to pond in those areas. The City Safety Inspector also <br /> inspected the building noting severe deterioration of the structure, <br /> as well as several electrical control panels without covers, wiring <br /> that is not in compliance with city codes, only one fire extinguisher <br /> evident (that did not have a current inspection tag), a rotten weeden <br /> laader attached to the building and providing the only access to the <br /> roof, that will not support any Height. The safety officer also <br /> stated "\\1e could not find an i¡;surance company to provide us wi t~ <br /> insurance coverage on this structure." <br /> The airport commission considers this building to be a hazard, not <br /> only to its occupants, but to other tenants as well. The co~~ission <br /> strongly recol1'.mends that the City ta~:e the necessary action to <br /> condemn this building, and buy-out or terminate the lease for the <br /> ~uilding. To allow an unsafe condition of which the city is aware, <br /> to continue to exist, may result in serious legal liability, <br /> irregardless of "hold harmless" lease clauses. <br />The exerpt above is from the Commissions 1984 report. The condition of <br />the building has continued to deteriorate. An independent structural <br />engineer \"ill be inspecting the building in mid-February to deterDine <br />the structural soundness of the building. ~ve continue to have problems <br />acquiring insurance on the building. To date, \"e have not found an <br />insurance company \"ill ing to insure the building. <br />A portion of the City's underground fuel storage tanks are on <br />Chandeliers leased property. The tanks are leased to another tenant at <br />the Airpo rto Review of lease shows compliance with all provisions with <br />the following exceptions: (1) A current copy of the required <br />insurance is not on file with the City; (2) ~vhethe r or not Chandelle <br />has maintained and repaired the building is questionable. <br />RECOMMENDATIONS: <br />1. Delete the section of land containing the fuel storage tanks <br /> from the lease and reimburse lessee for fees paid on that <br /> section. <br />
