3) Results. Communicate all test results to the City as soon as is practicable but in no event <br />later than 24 hours after tests are confirmed. The Consultant will provide all testing in a <br />confidential manner using appropriate means such as fax/ website /email. <br />B. CITY RESPONSIBILITIES <br />The City will: <br />1) Provide full and accurate information to the Consultant regarding the City's requirements <br />for the Consultant's services under this Agreement as available. <br />2) Designate Cindy Conyers, Risk Manager as the authorized representative to act as the <br />City's main point of contact with respect to this Agreement. The City will provide the <br />Consultant with a list of City personnel authorized to procure these services from the <br />Consultant and will keep such list updated as necessary. <br />5) Bear all costs incidental to this Article. <br />C. ADDITIONAL SERVICES /PROJECT ASSUMPTIONS <br />1. The City may direct the Consultant to perform services outside of the scope of the Basic <br />Services described in Section A above. The Consultant will submit a written estimate of fees to <br />the City and obtain the City's authorization before initiating any additional services. <br />2. Each material change (deletion or addition) in the services to be provided by the <br />Consultant must be authorized by the City on the Authorization of Change in Services form <br />attached to this Agreement as Attachment B. Compensation for additional services will be in <br />addition to that specified for Basic Services in accordance with Section A of this Agreement. <br />The approval of the San Marcos City Council is necessary for all additional services the <br />compensation for which exceeds $50,000.00. <br />D. BASIS OF COMPENSATION <br />1. BASIC SERVICES. <br />The total of all fees and expenses to be paid to the Consultant for the performance of Basic <br />Services as described in Section A will not exceed $15,000.00 annually. The City will pay the <br />Consultant within 30 calendar days of the performance of its services based on the Consultant's <br />submission and the City's acceptance of invoices, copies of priced by occurrence estimates and <br />payment requisitions. This agreement will automatically renew in accordance with Section in <br />accordance with Section 9 of Attachment B, Terms and Conditions. <br />2.
