3.02. City Approval of the Creation of the Zone. The City Council of City approved <br />this Agreement on December 17, 2013, which supported the creation of the Zone and approval <br />of the Project Plan and is attached as Exhibit `B ". <br />3.03. Area Included in the Zone. The area included in the Zone shall be the area <br />described by the attached Exhibit "C." <br />3.04 Obligations of Certain Parties to Support the Zone. After establishing a Zone, the <br />City, will endeavor to support station area planning, zoning and development implementation <br />that may result in multi use /transit oriented development (TOD) or other rail supportive growth <br />within each Zone. Staff of the participating taxing authorities with land use /zoning duties will <br />inform their respective governing bodies of the conformance of pending board decisions on land <br />use /zoning within the Zone with multi use /TOD uses. If appropriate, Zone participants will <br />support and work with the Rail District for the establishment and use of other funding <br />mechanisms (such as public improvement districts or municipal management districts) that allow <br />private property owners within the Zone to also participate in the establishment and ongoing <br />service provision of rail service funding. <br />3.05. General Statement Regarding Property Included Within the Zone. All property <br />designated on the maps or in the list of properties attached as Exhibit C shall be included within <br />the Zone and certain property described in 3.07 (a) and (b) shall also be included in the Zone. <br />(a) Property under common ownership, identified as Undivided Property on <br />Exhibit C shall be included within the Zone. Such property shall be included in the Tax <br />Increment on a prorated basis for the acreages designated for the property on Exhibit C or for the <br />subdivided portions of the property at least 50% within one -half (1/2) mile radius of the <br />corresponding station property. <br />-4- <br />
