7 RESOLUTION 1985-21R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING AND APPROVING THE TERMS AND CONDITIONS OF A PROPOSED AGREEMENT BETWEEN FREESE AND NICHOLS, INC. AND THE CITY OF SAN ~ßRCOS, TEXAS FOR THE PROVISION OF ENGINEERING SERVICES TO SAID CITY IN CONNECTION WITH THE REPLACEMENT AND/OR REHABILITATION OF THE SESSOM DRIVE SANITARY SEWAGE LINE¡ AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT AND ANY AND ALL OTHER DOCUMENTS AND INSTRUMENTS INCIDENT THERETO¡ AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas desires to en te r into a contract with Freese and Nichols, Inc. for the provision of engineering services to said City in connection with the replacement and/or rehabili ta tion of the Sessom Drive sanitary sewage line in said City; and, WHEREAS, said City Council finds and determines it to be in the interest and welfare of the public to enter into such an agreement; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of a proposed agreement between Freese and Nichols, Inc. and said City, a copy of which is attached hereto and incorporated herein for all purposes, for the provision of engineering services to said City in connection with the replacement and/or rehabilitation of the Sessom Drive sanitary sewage line, are hereby authorized and approved. PART 2. That the Mayor be, and she is hereby, authorized to execute said agreement on behalf of said City and any and all other documents and instruments incident thereto. PART 3. That this Resolution shall be in full force and effect from and after its passage. ADOPTED this 4 day of March , 19 85 . z- ,~- Û .
