<br />14 <br /> <br />Regular Meeting <br /> <br />September 8, 1986 <br /> <br />Page 14 <br /> <br />Mayor Younger introduced for discussion a discussion by Baltimore <br />Selvera (on agenda Silguero). Mrs. Selvera advised the Council the <br />family had been denied sewer service since 1948 when the property <br />was the homestead of her husband's family. They have made requests <br />through the years and each time been denied service. Mr. Hankins <br />stated the service is available but the City's legal obligation is <br />to provide no more than it does for anyone else by our extension <br />policy, wherein the City provides 100 feet and the Selveras would <br />have to pay for the remainder of the system. Mr. Hankins advised <br />the City could place a lien on the property and provide the extension <br />to service the Selveras. Mr. Gonzalez stated an inexpensive solution <br />would be a new septic tank. He stated only a 4n line would be needed <br />to provide the Selvera's immediate needs, but if a lien is used to <br />provide the service by the City, then he suggests the City put a 6" <br />line in for potential development, which line and lift station could <br />run $50,000 and that a source of funding could be System Improvements. <br />The Council directed the Staff try to work something out with the <br />Selveras. Mr. Nicola stated he would like to see the City provide <br />the Selveras needs in a financial manner. The Staff was also directed <br />to contact SWT to see if they would consider participating in the develop- <br />ment of this line. Mayor Younger told the Selveras he would try to <br />respond to them within two weeks. <br /> <br />Mayor Younger introduced a discussion regarding the reconstruction of <br />Dunbar. Jeff Kester made a presentation of the preliminary layout for <br />the building with the Council, which included entrance to the building <br />on the Comal side, foyer, recreation room, restrooms, a large multi- <br />purpose meeting room, kitchen, and workroom with kiln for the Senior <br />Citizens. The Council directed an area for a stove be added to the <br />design. <br /> <br />Mayor Younger introduced an item out of order on the agenda, Item 17. <br />Mr. Nicola moved the Council adjourn into Executive Session pursuant <br />to Article 6252-17, ~~2(e) and (g), V.A.C.S., to discuss pending liti- <br />gation (Colatex vs. City) and matters where the duties of the City At- <br />torney to the City pursuant to the Code of Professional Responsibility <br />of the State Bar of Texas clearly conflicts with Article 6252-17, and <br />to discuss employment, reassignment, duties and complaints or charges <br />against a public officer or employee, respectively, and Mr. Guerra se- <br />conded the motion, which passed unanimously (12:45 a.m.). <br /> <br />Ms. Kissler moved the Council reconvene at 1:56 a.m. and Mr. Farr se- <br />conded the motion, which passed unanimously. <br /> <br />Ms. Kissler moved to remove Item 15 from the table (Municipal Court <br />space) and Mr. Coddington seconded the motion, which passed unani- <br />mously. <br /> <br />Mayor Younger introduced for consideration Item 15 removed from the <br />table, the source of funding for temporary Municipal Court Judge's <br />Chambers for a six-month period and funding of same. Mr. Coddington <br />moved to fund from contingency funds the amount of $1,051.80, $175.00 <br />of which is out of the 85-86 budget and the remainder from 86-87 <br />budget and Mayor Younger seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration an addendum to the agenda, <br />Item 16-1/4, to receive and accept the appraisal roll and effective <br />tax rate, which was acknowledged by the Council. <br />
