<br />4 <br /> <br />Regular Meeting <br /> <br />September 8, 1986 <br /> <br />Page 4 <br /> <br />Mayor Younger introduced for consideration a public hearing and approv- <br />al of an Ordinance on first reading, the caption which was read as fol- <br />lows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE MASTER PLAN OF SAID CITY <br />BY AMENDING A PORTION OF MAP IV-I, FUTURE LAND USE PLAN, <br />TO ADD MAP IV-lA (WHICH INCLUDES THE AREA COMMONLY KNOWN <br />AS PRIORITY AREA I), AND AMENDING ALL REFERENCES IN SAID <br />MASTER PLAN FROM "MAP IV-I" TO "MAP IV-l AND MAP IV-lA" , <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the amendment. Jay Moore stated <br />this amendment would change some property which he owns from 0-6 to <br />0-3 designation. He stated there would be a loss of value to his pro- <br />perty. He stated zoning in San Marcos has been replaced by the Master <br />Plan in that you must bring zoning into compliance with the Master Plan. <br />Mr. Moore stated the area where his property is located. Mr. Robbins <br />stated the area Mr. Moore was addressing is some of the most environmen- <br />tally sensitive area in the City, and that pollution would reach the <br />City's well within hours. Mr. Moore stated 0-6 designation is more <br />valuable than 0-3 and that the City needs to address fairness because <br />it would be lowering the value of the property. Mr. Hankins advised <br />the Council that personal, private gain or loss should never be con- <br />sidered. He stated decisions sometimes help and sometimes hurt value <br />of property, but for the City to be on sound, legal ground, decisions <br />should not be made with that in mind, that the Council should only <br />consider the welfare of the community. Mr. Robbins stated that a <br />transfer of rights could be made from one piece of property to another, <br />and that a PDD could be used where the City gives bonuses, i.e., open <br />space. Mr. Gonzalez indicated there is no area to transfer property <br />rights that needs more density. Mr. Robbins advised the Council the <br />amendment before them needs to be further amended as follows: (1) <br />River Ridge from Industrial to Mixed Use and (2) Wyatt Tract from <br />Medium Density to Medium Density, Low Density and Commercial. Gene <br />Phillips stated he thought the 0-6 designation should be allowed or <br />that a property owner be allowed to transfer rights elsewhere. No one <br />else wished to speak for or against, so Mayor Younger closed the public <br />hearing. Ms. Kissler moved for approval of the Ordinance on first <br />reading and for the two amendments of River Ridge and Wyatt Tract to <br />be amended and included and Mr. Nicola seconded the motion. On roll <br />call the following vote was recorded: <br /> <br />AYE: Brown, Farr, Guerra, Kissler, Nicola. <br /> <br />NAY: Coddington, Younger. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Younger introduced for consideration a public hearing and approv- <br />al of an Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 30 OF THE SAN MARCOS <br />CODE OF ORDINANCES TO INCLUDE ARTICLE III, DIVISION I <br />TO BE ENTITLED "INDUSTRIAL WASTE ORDINANCE", REGULATING <br />THE DISCHARGE OF INDUSTRIAL WASTE INTO THE SANITARY SEWER- <br />AGE SYSTEM AND THE STORM DRAINAGE SYSTEM OF THE CITY OF <br />SAN MARCOS BY DEFINING TERMS, REQUIRING STRUCTURES, PROVID- <br />ING FOR PERMITS FOR DISCHARGING INDUSTRIAL WASTE INTO A <br />PUBLIC SEWER OR WATERCOURSE, AUTHORIZING DISCONNECTION OF <br />WATER AND/OR SANITARY SEWER SERVICE TO PERSONS VIOLATING <br />THIS ORDINANCE, PROVIDING FOR INSPECTION AND SAMPLYING OF <br />INDUSTRIAL WASTE DISCHARGES, PROHIBITING THE DISCHARGE OF <br />CERTAIN WASTES INTO PUBLIC SEWERS OR WATERCOURSES, REQUIRING <br />
