<br />5 <br /> <br />Regular Meeting <br /> <br />September 8, 1986 <br /> <br />Page 5 <br /> <br />PRETREATMENT OF CERTAIN INDUSTRIAL WASTES, PROVIDING <br />A SURCHARGE FOR NORMAL SEWAGE, AUTHORIZING THE DIRECTOR <br />OF ENVIRONMENT AND ENGINEERING TO DETERMINE THE SUFFI- <br />CIENCY OF PRETREATMENT~ MAKING THIS ORDINANCE CUMULATIVE <br />OF PRIOR ORDINANCES AND PROVISIONS OF SAN MARCOS IN CON- <br />FLICT WITH IT~ PROVIDING REMEDIES~ PROVIDING PENALTIES~ <br />PROVIDING FOR SEPARABILITY~ AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the Ordinance. Bill Hainey of Indus- <br />trial Solvents asked why the Ordinance had been delayed for 16 months, <br />to which Steve Jenkins responded it was being reviewed by the Engineer- <br />ing and Legal Staffs. Mr. Jenkins responded some of the institutions <br />which would be affected by the Ordinance would be institutions that <br />have boilers, metal shops, paint shops, industrial processors, carwash- <br />es, meat processing plants, chemistry labs, restaurants, dry cleaners. <br />Mr. Jenkins stated we are required to have such an Ordinance in place <br />when our new treatment plant is completed, being a federal requirement. <br />Mr. Hainey asked if we had equipment in place to do monitoring, and Mr. <br />Jenkins stated the treatment plant lab equipment will be in place with- <br />in 60-90 days. Mr. Hainey wanted to know who would monitor businesses' <br />wastes, and Mr. Jenkins stated large operations will police themselves <br />and the City will spot sample smaller operations. Mr. Hainey stated the <br />Ordinance gives the Director of Environment and Engineering too much <br />power. Mr. Hainey stated the listing of chemicals (30-66) needs to be <br />narrowed and he would like to provide recommendations to the City how <br />to handle the listing of who has what chemicals. Mr. Hainey said he <br />does not think it will be feasible to enforce this Ordinance. Mr. <br />Jenkins stated air conditioning shops and service stations are exempted <br />from this Ordinance unless they have sand and grease traps. Mr. Nicola <br />said fluids leaking on the streets are a source of pollution, and Mr. <br />Jenkins responded that vehicular traffic is not addressed in this Ordin- <br />ance, only customers on the wastewater system. Mr. Hankins stated the <br />Municipal Court Judge will serve as hearing examiner, and although the <br />Judge would not have expertise, it would be the responsibility of the <br />parties to provide information to the Judge to make a decision. The <br />time of hearing could be shortened from the 60-90 days mentioned in <br />the Ordinance to whatever time the Council considers reasonable. The <br />Council could serve to hear appeals, but Mr. Hankins thought it would <br />be appropriate for the Municipal Court Judge to serve as hearing <br />examiner. No one else wished to speak in favor or in opposition, so <br />Mayor Younger closed the public hearing. Mr. Nicola moved to approve <br />the Ordinance on first reading and Mr. Guerra seconded the motion. Mr. <br />Nicola stated he would like Mr. Hainey's ideas entertained by Mr. <br />Jenkins, such as speeding up the process. Mayor Younger stated he <br />would like the City to receive input from others, including Hughson <br />Meat Company. Mr. Farr stated he felt the Ordinance needs some refine- <br />ment. Ms.. Kissler stated maybe some of the testing could be reduced, <br />as suggested by Mr. Hainey. Mr. Jenkins advised the Council the Ordin- <br />ance must be in place before the grant for the treatment plant is com- <br />pleted. Mr. Farr suggested a Workshop be scheduled for an exchange of <br />information with users, engineers and maybe have another City with such <br />an Ordinance participate in the discussion as to how their Ordinance <br />works. Mr. Nicola suggested an informal Workshop be arranged for in <br />which the Council could also attend. Mr. Farr requested Ms. Millecam <br />prepare a news release regarding the public session. Mr. Nicola with- <br />drew his motion for approval on first reading, but Mr. Guerra did not <br />withdraw his second to the motion. Mr. Parr moved to table the Ordin- <br />ance until after the work session and Mr. Coddington seconded the motion. <br />On roll call the following vote was recorded: <br />
