<br /> 49 <br /> CONTRACT FOR ENGINEERING SERVICES <br /> THIS CONTRACT, executed between the City of San Marcos; <br /> Texas, hereinafter called the CITY, and BLACK & VEATCH, <br /> Engineers-Architects, of Dallas, Texas, hereinafter called <br /> the ENGINEER: <br /> WITNESSETH: That in consideration of the mutual covenants <br /> herein contained, the CITY hereby agrees to employ the <br /> ENGINEER to perform the services hereinafter outlined in the <br /> Scope of Work, a part of this contract, designated as <br /> Appendix B. <br /> SECTION I - SCOPE OF SERVICES <br /> The ENGINEER agrees to pe rform engineering services in <br /> connection with the investigation, study, and report, and <br /> provide supplemental services as requested. A description of <br /> the basic services to be performed is outlined in the Scope <br /> of Work, Appendix B. <br /> SECTION II - COMPENSATION <br /> A. For the basic services outlined in Appendix B, the CITY <br /> ag rees to pay the ENGINEER a fee computed on the basis <br /> of 2.1 times actual payroll cost, whe re actual payroll <br /> cost is defined as direct salaries plus 30 percent, for <br /> all of the ENGINEER's personnel engaged on the work plus <br /> reimbursement for expenses directly chargeable to the <br /> work as defined in Paragraph B. It is mutually <br /> understood that the upper billing limit for Phase I <br /> services shall not exceed Twenty-One Thousand Dollars <br /> ($21,000) without further authorization from CITY. It <br /> is understood that 50 percent of the labor portion of <br /> the fee shown in Appendix A attached ($9,450) is <br /> credi table to fees that may be paid the ENGINEER for <br /> Phases II and III work in Appendix B. Phases II and III <br /> work will commence only upon written authorization from <br /> the CITY and after a mutually agreeable upper billing <br /> limit schedule and time for performance schedule for the <br /> Phases II and III work has been negotiated by the CITY <br /> and the ENGINEER. Revisions in the Phases II and III <br /> Scope of Services, if necessary, shall also be as <br /> mutually agreed upon by the CITY and the ENGINEER. <br /> B. Reimbursable direct expenses chargeable to the project <br /> and included in the billing limit are: <br /> 1. Travel and subsistence incurred in the performance <br /> of this agreement and during absence from, <br /> ENGINEER's office in Dallas. <br />
