<br />.;: AN ORDINANCE OF 'mE CI'IY COUNCIL OF THE CI'IY OF SAN
<br />MARCOS, TEXAS, ABANDONING AND VACATING A roRTION OF A
<br />FIFTEEN FOOT (15') WIDE ALLEY, 'mE SJUTHEAST LINE OF
<br />1'<'\ WHICH AJ)JOINS THE NORTHWESTERN roUNDARY, OF W.A.
<br />î'tJ 'mOMPSJN'S ADDITION 'IO THE CI'IY OF SAN MARCOS, TEXAS;
<br />AU'mORIZING THE MAYOR OF SAID CITY 'IO EXOCUTE A SPOCIAL
<br />WARRANTY DEED; REFLOCTING PAYMENT OF THE FAIR MARKET
<br />VALUE OF $250.00; PROVIDING FOR '!HE REVERSION OF FEE IN
<br />SAID LAND AND DECLARING AN EMERGENCY.

<br />
<br />WHEREAS, a portion of an alley fifteen (15) feet in width on the
<br />northwest side of the W.A. Thompson's Addition to the City of
<br />San Marcos, the plat of said addition recorded in Volume 54, Page 630,
<br />Hays County Deed Records, and being the northeast 291.14 feet of
<br />said portion of said alley, as shown on said plat; was and is
<br />dedicated to public use on the plat of the W.A. Thompson's Addition to
<br />the City of San Marcos of record in Volume 54, Page 630 of the Deed
<br />Records of Hays County, Texas; and,
<br />
<br />WHEREAS, the City of San Marcos has been requested by Glendon G.
<br />Bagwell to abandon said portion of said alley; and,
<br />
<br />WHEREAS, said City has previously, by ordinance duly adopted on
<br />February 10, 1949, abandoned all of the streets and alleys wi thin the
<br />said W.A. Thompson's Addition except the alley on the northwest side of
<br />said Addition of which the portion requested by Glendon G. Bagwell for
<br />abandonment is a part thereof; and
<br />
<br />WHEREAS, the northwest line of said alley on the northwest side of
<br />said Addition is the northwest boundary of said Addition; and,
<br />
<br />\.;JHEREAS, the City of San Marcos has duly determined that Glendon
<br />G. Bagwell is the sole owner of all property abutting said portion of
<br />said alley within said W.A. Thompson's Addition; and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas, has
<br />determined that it is in the public interest to abandon said portion of
<br />said alley; and,
<br />
<br />vlliEREAS, Glendon G. Bagwell, has executed a release, discharg ing
<br />said City from any damages occasioned by said vacation and abandonment;
<br />and,
<br />
<br />WHEREAS, the City of San Marcos has determined by appraisal that
<br />the fair market value of said property is $250.00 and the same has
<br />previously been deposited with said City; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SOCTION 1. That a portion of an alley fifteen (15) feet in width
<br />on the west side of the W.A. Thompson's Addition to the City of San
<br />Marcos, the plat of said subdivision recorded in Volume 54, Page 630,
<br />Deed Records of Hays County, Texas, and being the northeast 291.14 feet
<br />of said portion of said alley as shown on said plat and being more
<br />particularly described by metes and bounds as follows:
<br />
<br />BEGINNING at the intersection of the Southeast line of said
<br />alley with the southwest line of Academy Street at the
<br />North corner of that parcel of land described in and
<br />conveyed by that deed from Ruth Ianham to Glendon G.
<br />Bagwell dated the 4th day of January, 1980 and recorded in
<br />Volume 237, Page 299-301, Deed Records of Hays County,
<br />Texas;
<br />
<br />'!HENCE north 45° œst 15 feet and with said Southwest
<br />line of Academy Street 15 feet, more or less, to a point
<br />where the Northwest line of said alley intersects with the
<br />southwest line of Academy Street;
