That Section 10-3 of Article I of Chapter 10 of the <br />Code of Ordinances of the City of San Marcos, Texas, is hereby deleted <br />in its entirety. <br /> <br />SæTION 2. That Section 10-38 of Article III of Chapter 10 of the <br />Code of Ordinances of the City of S:m Marcos, Texas, is hereby arænded <br />to adopt the 1976 edition of the Fire Prevention Code and its November <br />1982 arændments recommended by the American Insurance Association. <br /> <br />SECTION 3. That Section 10-39(a) of Article III of Chapter 10 of <br />the Code of Ordinances of the City of San Marcos, Texas is hereby <br />amended to read as follows: <br /> <br />ARTICLE III. FIRE PREVENTION CODE <br /> <br />Sec. 10-39. Penalties <br /> <br />(a) Any person who shall violate any of the provisions of the <br />Fire Prevention Code adopted or fail to comply therewith, or who <br />shall violate or fail to comply with any order made thereunder, <br />or who shall build in violation of any detailed staterænt of <br />specifications or plans submitted and approved thereunder, or <br />any certificate or permit issued thereunder, and from which no <br />appeal has been taken, or who shall fail to comply with such an <br />order as affirmed or modified by the municipal court of the City <br />of San Marcos or by a court of competent jurisdiction, within <br />the time fixed herein, shall severally for each and ever¡ such <br />violation and noncompliance respectively, be guilty of a <br />misdemeanor, punishable by a fine of not less than two hundred <br />dollars ($200.00) nor more than one thousand dollars ($1,000.00) <br />unless otherwise provided elsewhere in this Chapter or in said <br />Fire Prevention Code. The im'X)sition of one penalty for any <br />violation shall not excuse the violation or permit it to <br />continue; and each day that such violation continues shall <br />constitute a separate offense. <br />
