<br /> SECTION 4. That Section 10-39(c) of Article III of Chapter 10 of <br /> the Code of Ordinances of the City of San Marcos, Texas, is hereby <br /> amended to read as follows: <br /> Sec. 10-39. Fenalties. <br /> . .. <br /> (c) This article shall be applicable and in force wi thin the <br /> city limits of the City of San Marcos, and for a distance of and <br /> within five thousand (5,000) feet outside said city limits; <br /> provided that this article shall not apply within any portion of <br /> such five thousand (5,000) feet which is contained within the <br /> territory of any other municipal corporation. <br /> sæTION 5. That the present amendment of Section 16.75 of the <br /> 1970 ed i tion of the Fire Prevention Code contained in Section 10-41 <br /> of Article III of Chapter 10 of the Code of Ordinances of the City of <br /> San Marcos, Texas, is hereby deleted. <br /> SECTION 6. That Section 10-41 of Article III of Chapter 10 of the <br /> Code of Ordinances of the City of San Marcos, Texas, is hereby a:rn:E!nded <br /> to read as follows: <br /> Sec. 10-41. Amendments. <br /> [The Fire Prevention Code adopted in section 10-38 is hereby <br /> a:rn:E!nded in the following respects:] <br /> a. Section 13.3(a) shall be amended to read as follows: <br /> Section 13.3. Storage, Manufacture, Sale and Discharge of <br /> Fireworks. <br /> (a) The manufacture, storage, sale, and discharge of <br /> fireworks is prohibited within the city limits of the City of <br /> San Marcos and for a distance of and within five thousand <br /> (5,000) feet outside said city llinits. <br /> b. SUbsections (1) and (2) of Section 13.3(a) are hereby <br /> deleted. <br /> c. The caption of Section 16.99 shall be a:rn:E!nded to read as <br /> follows: <br /> Section 16.99. Transportation, Parking and Garaging. <br /> d. Section 16.99 is hereby amended to read as follows: <br /> Section 16.99. Transportation, Parking and Garaging. <br /> (a) Except in an e:rn:E!rgency as provided in subsection (c) <br /> below, no tank vehicle, whether loaded, partially loaded or <br /> empty, shall be left unattended on any street, highway, avenue <br /> or alley within the city limits, provided that this shall not <br /> prevent a driver from the necessary absence from the truck in <br /> connection with the delivery of his load, except that during <br /> actual discharge of the liquid SO:rn:E! responsible person shall <br /> be present at the vehicle, and such vehicle shall not be <br /> parked out of doors at anyone point for longer than one (1) <br /> hour and must be located at least 50 feet from any buildings <br /> used for assembly, institutional, or mul ti pIe residential <br /> occupancy purposes, nor shall it prevent stops for :rn:E!als for <br /> a maximum of one (1) hour during the day or night; however, <br /> such stops for :rn:E!als shall be made only at the San Marcos <br /> Truck Stop located at the west intersection of IH-35 and <br /> L.B.J. Drive in said City. The term "Necessary Absence" <br /> shall :rn:E!an invoicing of load and collection of invoice. <br />
