<br /> (b) It shall be unlawful for any person to drive or cause to <br /> be driven, or operate or maintain any motor vehicle, motor <br /> truck, trailer or any other vehicle having thereon, or <br /> attached thereto, a tank or other receptacle used or <br /> for use in carrying (100 gallons or more) gasoline, butane, <br /> propane, methane, octane, pentane or any other kind of <br /> liquefied petroleum or natural gas products or any other <br /> flammable or combustible liquids, or any hazardous chemicals <br /> or other dangerous articles whether loaded, partially loaded <br /> or empty, over any street or alley wi thin the corporate <br /> limi ts of the city, except over the following designated <br /> streets and highways, to-wit: <br /> All State and Federal Highways; provided, however, that <br /> other streets may be traveled upon when they are designated by <br /> the Fire Chief or Fire Marshal or their designees with the <br /> approval of the city council by visible markers and signs, <br /> when in the opinion of the Fire Chief or Fire Marshal or <br /> their designees and the city counc il, the safety of the <br /> property and its citizens demands; or when the operator of <br /> said motor vehicle, rrotor truck, trailer, or other such <br /> vehicle has obtained a valid permit from the Fire Chief or <br /> Fire Marshal to travel upon other streets within said City. <br /> (c) Subsections (a) and (b) above shall not apply under the <br /> following or in the following circumstances: <br /> (1) When any such truck, motor vehicle or trailer, <br /> loaded or partially loaded, has stopped at a filling <br /> station or garage for necessary repairs, with the <br /> further provision that the same shall not remain at <br /> such filling station or garage longer than thirty <br /> (30) minutes unless fire and police authorities are <br /> notified that it is necessary to remain for a longer <br /> period than thirty ( 30) minutes. However, in all <br /> such instances, unless linpossible as determined by <br /> police or fire authorities, the trailer shall be <br /> moved to the San Marcos Truck Stop located at the <br /> west intersection of IH-35 and L.B.J. Drive in said <br /> city or the contents therein shall be transferred to <br /> another container attached to a vehicle not in need <br /> of repairs. <br /> (2) When any such truck, motor vehicle or trailer has <br /> broken down, has a flat tire or becomes out of <br /> repair or out of gasoline for its own propulsion to <br /> the extent that it cannot be propelled with its own <br /> power, provided that the driver of such motor <br /> vehicle shall imrœdiately notify fire and <br /> police authorities of such forced stoppage. If such <br /> vehicle as above described can be repaired within a <br /> period of two (2) hours, then such repairs may be <br /> made where such vehicle has been forced to stop, <br /> provided that during such period of repairs a <br /> policeman or fireman remains at such place of <br /> stoppage to warn other persons using the highway, <br /> street or avenue of such danger. <br /> ( 3) ~'Vhen any such motor truck, motor vehicle or trailer <br /> is loaded or partially loaded and has broken down <br /> and is out of repair to the extent that the same <br /> cannot be repaired within two (2) hours and fire <br /> and police authorities have been notified, and the <br /> same is being removed from such place of stoppage <br /> or breakdown to a gar age or to some other place <br /> within the corporate limits of the city under the <br /> direction of fire or police authorities to a place <br /> designated by the fire department. However, in all <br /> such instances, unless impossible as determined by <br /> police or fire authorities, the trailer shall be <br /> moved to the San Marcos Truck Stop loca ted at the <br /> west intersection of IH-35 and L.B.J. Dirve in said <br /> City or the contents therein shall be transferred <br /> to another container attached to a vehicle not in <br /> need of repairs. <br />
