<br /> are hereby authorized and empowered to enforce the <br /> provisions of this section. <br /> SECTION 7. That Sections 10-43,10-44 and 10-45 of Article III of <br /> Chapter 10 of the Code of Ordinances of the City of San Marcos, Texas, <br /> are hereby deleted. <br /> SECTION 8. That Section 10-46 of Article III of Chapter 10 of the <br /> Code of Ordinances of the City of San Marcos, Texas, is hereby arænded <br /> to read as follows: <br /> Sec. 10-46. Establishment of motor vehicle routes for vehicles <br /> transporting explosives and blasting agents. <br /> The u.S. Department of Transportation regulations referred to <br /> in Section 12.7 of the Fire Prevention Code and all other <br /> applicable requirements set forth in said Code for the <br /> transporta tion of explosives shall be folloæd; however, the <br /> transportation of explosives to a site previously approved by <br /> the Fire Marshal shall be only along the route previously <br /> approved by the Fire Marshal to such site. <br /> SECTION 9. That Section 10-47 of Article III of Chapter 10 of the <br /> Code of Ordinances of the City of San Marcos, Texas, is hereby arænded <br /> to read as follows: <br /> Sec. 10-47. Establishment of motor vehicle routes foe vehicles <br /> transporting hazardous chemicals or other dangerous <br /> articles. <br /> The u.S. Department of Transportation regulations referred to <br /> in Section 20.14(a) of the Fire Prevention Code for the <br /> transportation of hazardous chemicals and other dangerous <br /> articles shall be followed except: Tank vehicles transporting <br /> gasoline and other flammable liquids to service stations may <br /> take the nearest route to the station served. <br /> SECTION 10. That the following Sections of Chapter 10 of the Code <br /> of Ordinances of the City of San Marcos, Texas, set forth hereinbelow <br /> in the left-hand column are hereby renumbered as set forth hereinbelow <br /> in the right-hand column: <br /> Section 10-4 Section 10-3 <br /> II " 10-5 II "10-4 <br /> II II 10-6 " "10-5 <br /> " " 10-46 " "10-43 <br /> " " 10-47 II "10-44 <br /> " " 10-48 " "10-45 <br /> " " 10-49 " "10-46 <br /> " II 10-50 II "10-47 <br /> SECTION 11. That all ordinances or parts of ordinances <br /> inconsistent with the terms of this Ordinance are hereby repealed; <br /> provided, however, that such repeal shall be only to the extent of such <br /> inconsi s tency and in all other respects this Ordinance shall be <br /> cumulati ve of other ordinances r-egulating and governing the subject <br /> matters cover-ed by this Or-dinance. <br /> SECTION 12. That if any section, clause, paragraph, sentence, or <br /> phrase of this Ordinance shall, for any reason, be held to be invalid <br /> or unconstitutional, such invalid section, clause, paragraph, <br /> sentence, or phrase is hereby declared to be sever-able and any such <br /> invalid or unconstitutional section, clause, par-agraph, sentence, <br /> or phrase shall in no way affect the remainder of this Ordinance, <br /> and it is hereby declared to be the intention of the Counc i1 <br /> that the remainder of this Ordinance would have been passed <br /> notwithstanding the invalidity or unconstitutionality of any section, <br /> clause, paragraph, sentence, or phrase thereof. <br /> SECTION 13. 'That the importance of this Ordinance creates an <br /> en~rgency and an imperative public necessity so that the provisions of <br /> the Charter requiring that ordinances shall be presented at three separate <br /> meetings and that no ordinance shall become effective until the expiration <br /> of ten (10) days following the date of its final passage be suspended, and <br />
