Restoration of disturbed areas that contain <br />native woody and herbaceous plants shall be <br />accomplished only as approved by the Director. <br /> <br />c. Stabilization of eroding creek banks is <br />permitted in order to protect threatened property, <br />but only as approved by appropriate federal and <br />state agencies and the Director. All such projects <br />shall be designed to stabilize existing conditions <br />only. <br /> <br />D. No excavation, or filling, greater than two <br />(2) feet that would alter existing drainage <br />patterns or the maintenance of flood and flow <br />characteristics shall be allowed unless: <br /> <br />1. Such excavation or filling shall be <br />necessary for the purpose of structural <br />engineering or is in the area where a <br />structure will be completed, such as for a <br />building foundation, or <br /> <br />2. Such excavation or filling as demonstrated <br />and certified by a registered professional <br />engineer will improve the water quality of the <br />runoff and/or stabilize an existing area of <br />erosion and will continue the maintenance of <br />flood and flow characteristics. <br /> <br />3. Required Plans. Plans showing proposed <br />excavation or filling of greater than two (2) <br />feet shall be provided to the Director and <br />shall become part of the plans required in the <br />Drainage and Erosion Control Ordinance. Said <br />plans shall be drawn to scale, between one (1) <br />inch to twenty (20) feet to one (1) inch to <br />fifty (50) feet, have two (2) foot contour <br />intervals, and be certified by a registered <br />professional engineer. <br /> <br /> <br />Sec. 8. Wastewater collection and disposal. <br /> <br />No development within the City limits of San <br />Marcos shall be permitted in the SMRC which <br />proposes to make use of septic tanks, holding <br />tanks, evapotranspiration units, cesspools or other <br />private or individual sewerage disposal systems. <br /> <br />Sec. 9. Creation of impervious cover. <br /> <br />A. Roads, parking areas, buildings, and other <br />impermeable construction covering the existing <br />natural land surface shall be considered as <br />impervious cover. No subdivision of land or <br />construction on the land shall be allowed to create <br />impervious cover as follows: <br /> <br />1. in excess of thirty (30) percent on land <br />that slopes more than fifteen percent <br />(15%), <br /> <br />2. in excess of twenty (20) percent on slopes <br />of between fifteen (15) and twenty-five <br />(25) percent, nor <br /> <br />3. in excess of ten (10) percent on slopes <br />greater than twenty-five (25) percent and <br />within a floodway that is within the San <br />Marcos River Corridor. <br />
