<br /> -16- <br /> B. Any person violating any provision of this <br /> ordinance within the jurisdiction of the City of <br /> San Marcos shall be guilty of a misdemeanor, and <br /> upon conviction shall be fined an amount not <br /> exceeding two hundred dollars ($200.00). Each day <br /> that such violation continues shall be a separate <br /> offense. Prosecution or conviction under this <br /> provision shall never be a bar to any other remedy <br /> for relief from violations of this ordinance. <br /> C. The City of San Marcos may bring suit on <br /> behalf of the City, in a court of competent <br /> jurisdiction to restrain and enjoin any person who <br /> attempts to carry out any plan for a subdivision or <br /> construction pursuant to this ordinance without <br /> first obtaining approval of said subdivision plan <br /> or building permit as required by law and the <br /> ordinances of the City of San Marcos or any person <br /> who fails to cease and desist from further <br /> development or construction under Section 18a. <br /> Sec. 19. Savings Clause. <br /> If any section, part, word, phrase, clause or <br /> sentence or any provision of this ordinance is <br /> declared unconstitutional or invalid, then, in that <br /> event, it is expressly provided and it is the <br /> intention of the governing body in passing this <br /> ordinance that all other parts of this ordinance <br /> shall not be affected thereby and shall remain in <br /> full force and effect. <br /> SECTION 2. That Chapter 36 of the Code bf Ordinances of <br /> the City of San Marcos, Texas, is hereby declared to be <br /> remedial and, therefore, applicable to all development, <br /> redevelopment and/or continuing development in the San Marcos <br /> River Corridor. <br /> SECTION 3. That any provision in any other existing <br /> ordinance of the City of San Marcos, Texas, which conflicts <br /> with any provision of Chapter 36 shall be and is declared to <br /> be repealed and invalid insofar as is necessary to prevent <br /> the conflict. <br /> SECTION 4.
