Assuming all nonresidential acreage is used: Tract A Tract B Floodplain 5 acres + 5 acres - 4 acres - 2.5 non-resi- dential acres = 3.5 residential acres. 3.5 acres x 6 units = 21 units Floodplain bonus = 80% x 21 units = 16.8 units = 17 units 21 + 17 = 38 units and 2.5 acres of nonresidential uses. Section 16. Conf1icting ordinances. It is the intention of the governing body that this ordinance should supplement existing ordinances, and any ordinance, word, phrase, clause, sentence, or section thereof in conflict with this ordinance shall remain in full force and effect; however, in the event that this ordinance shall impose a more restrictive requirement, then this ordinance shall control. Sec. 17. Enforcement. A. Where the Director, or his designated representative, determines that there is or has been noncompliance with any material term, condition or requirement pursuant to this ordinance, he shall order the person in noncompliance in writing to cease and desist from further development or construction, until he is in compliance. Said person may appeal an order to cease and desist to the Director by giving written notice. The Director shall hear the appeal within five ( 5) working days of receiving such notice. Said person may appeal in writing a negative ruling by the Director to the City Council, which shall hear the appeal at its next regular meeting following at least five (5) days after receipt of the notice.
