Private streets over <br /> public utilities shall not be <br /> authorized. Private utilities may <br /> not be authorized if any part of <br /> the utility serves off the site of <br /> the PDD. <br /> C. Easements. Publicly owned and/or <br /> maintained utilities shall be <br /> placed in public streets or <br /> easements a minimum of sixteen (16) <br /> feet in width. Dead-end easements <br /> shall not be permitted unless a <br /> City approved vehicular turnaround <br /> is provided at the end of each <br /> easement. <br /> 3. Garbage Collection. If in the opinion <br /> of the Director of Public Works, the <br /> private streets in the PDD are arranged <br /> so that garbage may be collected within <br /> the PDD without creating a safety <br /> hazard, the City of San Marcos will <br /> collect the garbage provided proper <br /> indemnification is received from the PDD <br /> property owners or community <br /> association. Garbage collected by the <br /> City or its contractor shall be placed <br /> at points designated by the developer <br /> subject to approval by the Director of <br /> Public Works and the Director of <br /> Environment and Engineering. <br /> 209. Non-Standard Design <br /> While recognizing that the engineering <br /> requirements and specifications in this <br /> ordinance and Appendix C, Subdivisions, are <br /> the standards, the Planning Commission may <br /> approve non-standard engineering designs <br /> which are consistent with sound engineering <br /> principles as determined by the Director of <br /> Environment and Engineering for privately <br /> owned and maintained facilities. <br /> COMMENTARY: This ordinance generally refers <br /> to Appendix C, when dealing with engineering <br /> design matters. This approach is <br /> appropriate¡ however, it may on occasion <br /> prove to be restrictive to innovative design <br /> when the goal of this ordinance as a whole is <br /> to provide for innovation. The intent of <br /> this section is to allow the Planning <br /> commission the prerogative of permitting <br /> innovation and flexibility through <br /> non-standard design. <br /> 210. Conformance with the City Master Plan. <br /> 1. A PDD must be in conformance with the <br /> City Master Plan. A PDD may be approved <br /> if it is at variance with the current <br /> Future Land Use Plan (map) but in <br /> conformance to the Plan's goals, <br /> objectives and policies. The burden of <br /> proof as to conformance to the Plan's <br /> goals, objectives, and policies shall <br /> rest with the PDD applicant. <br />
