<br /> -23- <br /> features are properly maintained and to <br /> prevent infringement on their designated <br /> uses, all general benefit features shown on <br /> the Development Plan and designed to be <br /> shared in common must either be: <br /> 1. Conveyed, with the approval of the city <br /> Council or the Planning Commission if <br /> the PDD is outside the city limits, to a <br /> responsible entity if that entity agrees <br /> to accept conveyance and to maintain the <br /> general benefit features; or, <br /> 2. Conveyed to a community association or <br /> similar organization which shall be <br /> responsible for the maintenance and <br /> improvement of the general benefit <br /> features. <br /> 502. Deed Restrictions <br /> If the general benefit features are not <br /> conveyed to a responsible entity, perpetual <br /> dedication and maintenance of the features <br /> shall be provided through deed restrictions. <br /> The deed restrictions shall run with the <br /> land, describe the general benefit features <br /> and their maintenance responsibilities, and <br /> provide for restricting the use of the <br /> general benefit features for the purposes <br /> designated in the Development Plan. All <br /> lands and facilities so guaranteed shall be <br /> subject to the right of the grantee(s) to <br /> enforce maintenance and improvements of the <br /> general benefit features. Deed restrictions <br /> for general benefit features may terminate <br /> with a change in the Development Plan or a <br /> change in zonlng if, in either case, no <br /> development has occurred which used density <br /> increment bonus factors associated with the <br /> gene,ral benefit features. When general <br /> benefit features are platted, the applicant <br /> shall provide the City with two (2) copies of <br /> the deed restrictions, one copy of which <br /> shall be recorded by the City at the time of <br /> plat recordation. <br /> 503. Guarantee of Performance <br /> When general benefit features which require <br /> site improvements other than the construction <br /> of dwelling units are involved in a plat, an <br /> instrument to ensure their establishment <br /> shall be executed by the applicant, subject <br /> to approval by the City Attorney, and filed <br /> with the Planning Commission together with <br /> the plat as provided for in Appendix C of the <br /> City Code. Subject to verification by the <br /> City, the obligation imposed by the <br /> performance guarantee shall be released by <br /> the City upon receipt of a letter from the <br /> applicant certifying that all required site <br /> improvements for the general benefit features <br /> have been completed. <br /> 504.
