On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Coddington, Farr, Younger, Kissler, Nicola. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Guerra. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE PERSONNEL MANUAL FOR EM- <br />PLOYEES OF THE CITY OF SAN MARCOS, TEXAS BY ADDING <br />PROVISIONS RELATING TO SEXUAL HARASSMENT AND AMENDING <br />ThE SECTIONS ON CONFIDENTIALITY OP RECORDS AND THE <br />GRIEVANCE PROCESS AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Guerra second- <br />ed the motion. Mr. Guerra asked what changes had been made regarding <br />confidentiality of records and stated he wants the employee notified <br />when someone wants access to their file. Mr. Hankins stated the City <br />Attorney's office must have assess to personnel files when involved <br />in litigation. Mayor Younger moved to amend Section 3.07. Confiden- <br />tiality of Records. in e. and f. to add "with notification to the <br />employee" to both sections and Mr. Farr seconded the motion, which <br />passed unanimously. Mr. Nicola moved to amend SECTION 5. in Sec. 11.00. The <br />Grievance Procedure. in Section C. Miscellaneous. to add the following <br />language: ".... The employee may be represented by an attorney or <br />any other person of his or her choosing¡ . . .", and Mr. Coddington - <br />seconded the motion, which passed unanimously. Mr. Coddington moved <br />to amend SECTION 1. in Section 1.05 Sexual Harassment Policy. in the <br />StaterÅ“nt of Policy to add the following word: " ... Any employee found <br />to have sexually harassed another City employee or other person with whom <br />the accused employee has had interaction partly or wholly because of his <br />or her status as a City Employee will be subject to disciplinary action. <br />. . .", and Hayor Younger seconded the motion, which passed unanimously. <br />On roll call for adoption of the Resolution the Council voted unanimous- <br />ly for adoption of the Resolution. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />AN INTERLOCAL AGREEMENT BETWEEN SAID CITY AND THE TEXAS <br />MUNICIPAL LEAGUE WORKERS' COMPENSATION JOINT INSURANCE <br />FUND AND A SUPPLEMENT TO SAID AGREEMENT FOR THE PROVISION <br />
