47 Regular Meeting October 27, 1986 Page 7 OF STATUTORY BENEFITS PRESCRIBED BY ARTICLE 8309h OF THE TEXAS WORKERS' COMPENSATION ACT FOR EMPLOYEES OF POLITICAL SUBDIVISIONS; APPOINTING PERSONNEL DIRECTOR AS WORKERS' COMPENSATION COORDINATOR FOR SAID CITY; AUThORIZING TEE MAYOR TO EXECUTE SUCH AGREEMENT, THE SUPPLEMENT THERETO, AND ANY AND ALL OTHER DOCUMENTS AND INSTRUMENTS INCIDENT TO THE PURPOSES OF SUCH AGREE- MENT; AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for adoption of the Resolution and Ms. Kissler se- conded the motion. Mr. Coddington asked if the City was going to bid out insurance or go with TML, and Mr. Gonzalez stated the Council had given him direction to proceed with TML in Executive Session (Mr. Coddington was not present at that rœeting). On roll call the following vote was re- rorded: AYE: Farr, Younger, Guerra, Kissler, Nicola. NAY: Coddington. ABSTAIN: None. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS RATIFYING THE CITY MANAGER'S EXECUTION OF AN AGREEMENT BETWEEN SAID CITY AND PATRICK WRIGHT DBA WRIGHT'S OUTDOOR AMUSEMENTS FOR ITS USE OF CITY PARKLAND FOR THE CONDUCT OF A CARNIVAL, AND DECLARING AN EFFECTIVE DATE. Mayor Younger moved for adoption of the Resolution and Mr. Guerra se- conded the motion. Mr. Hankins advised the Council the City Manager or Parks Director should be given direction to take care of these matters without Council approval. The Council voted unanimously for adoption of the Resolution. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, DETERMINING THAT CERTAIN ORIGINAL POLICE DEPARTMENT RECORDS OF SAID CITY ARE WORTHLESS, DIRECTING THE CITY MANAGER TO DISPOSE OF SUCH RECORDS IN A MANNER CALCULATED TO DESTROY THEM IN THEIR ENTIRETY, AND DECLAR- ING AN EFFECTIVE DATE. Mr. Farr moved for adoption of the Resolution and Mayor Younger seconded the motion, which passed unanimously. Mayor Younger introduced for consideration adoption of a Resolution finding that an excess of $606.10 in real property taxes was paid by Jack Eure, finding said amount to be erroneous, authorizing and ap- proving a refund in said amount by the Tax Collector. Mr. Hankins advised the Council the Tax Office had made an error regarding the amount, which is under $500.00 and does not require any Council action, so the Council moved to the next item on the Agenda.
