7 ORDINANCE 1985-82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE V OF APPENDIX C, SUBDIVISIONS, OF THE CODE OF ORDINANCES OF SAID CITY TO ADD A SECTION G THERETO, SETTING FORTH REQUIREMENTS FOR COMPLIANCE WITH CHAPTER 36, SAN MARCOS RIVER CORRIDOR, OF SAID CODE, AT THE TIME OF PLAT SUBMISSION AND PROVIDING FOR DESIGNATION OF PROPOSED LAND USE UPON PLATS WITHIN THE SAN MARCOS RIVER CORRIDOR; AMENDING SECTION H OF ARTICLE VI OF SAID APPENDIX OF SAID CODE TO ADD THERETO SUBSECTION (7), PROVIDING THAT LOT DESIGN SHALL TAKE INTO CONSIDERATION THE REQUIREMENTS OF THE LANDSCAPE AND BUFFERING ORDINANCE; AMENDING SECTION K OF SAID ARTICLE VI OF SAID APPENDIX OF SAID CODE TO NUMBER THE EXISTING PARAGRAPH THEREIN SUBSECTION (1) AND TO ADD THERETO SUBSECTIONS (2), ( 3) , (4) AND ( 5 ), SETTING FORTH REQUIREMENTS FOR THE PROVISION AND MAINTENANCE OF TREES AND GROUND COVER; AMENDING SAID ARTICLE VI OF SAID APPENDIX OF SAID CODE TO ADD THERETO A SECTION L, PROHIBITING APPROVAL OF PLATS HAVING MIXED LAND USES UNLESS BUFFERING YARD REQUIREMENTS SET FORTH IN ARTICLE I, PLANNED DEVELOPMENT DISTRICT, OF CHAPTER 35 OF SAID CODE, ARE MET; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, hereby finds and determines that it is in the interest of the public health, safety and welfare to adopt the following ordinance; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Article V of Appendix C of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to add a Section G thereto which shall read as follows: APPENDIX C SUBDIVISIONS . .. ARTICLE V. PROCEDURES . .. Section G. San Marcos River Corridor (SMRC). 1. In addition to the subdivision plat prerequisites detailed herein, proposed land use shall be designated with the preliminary, short form, and final plat of a subdivision within the SMRC. Such designation may be by a separate map at one (1) inch to two hundred (200) foot scale. The land use categories shown shall be the same as those used on the Future Land Use Plan (Map) in the Land Use Element of the City Master Plan except for residential densities.
