-3- 2. Maintaining trees along drainage ways. Subsection (d) of Section 14 1/2-5 of Chapter 14 1/2 of the City Code is adopted in full as part of this ordinance. 3. No paving with concrete, asphalt, or other impervious material within the tree crown zone (drip line zone) of trees to be preserved shall be allowed. 4. Soil and other materials shall not be temporarily or permanently stored in locations which would cause suffocation of root systems of trees to be preserved. 5. Permanent vegetation shall be installed at the construction site as soon as utilities are in place and final grades are achieved. The paving of streets, parking lots, and other areas shall be completed in conjunction with final grading. Final grading and removal of vegetation shall not occur more than 30 days prior to scheduled paving. SECTION 4. That Article VI of Appendix C of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to add thereto a Section 1 which shall read as follows: APPENDIX C SUBDIVISIONS . .. ARTICLE VI. SUBDIVISION DESIGN REQUIREMENTS . . . Section L. Mixed Land Uses. No plat shall be approved that has a mix of residential density types (e.g., single family, duplex, townhouse, apartment) or a mix of land uses unless the buffering yard requirements of Article I, Planned Development District, Chapter 35 of the City Code, have been met. A plat may be approved if those requirements are reflected in a note on the plat. An exception to this requirement shall be granted if the plat is part of an approved Planned Unit Development (PUD). SECTION 5. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the are~ as required by the Charter of the City of San Marcos, Texas.
