<br />20 <br /> <br /> <br /> <br />RESOLUTION 1985-60R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING THE <br />TERMS AND CONDITIONS OF A PROPOSED <br />CONTRACT BETWEEN SAID CITY AND LONGLEY <br />AND MAXWELL, ATTORNEYS AT LAW, FOR THE <br />PROVISION OF PROFESSIONAL LEGAL SERVICES <br />TO SAID CITY IN CONNECTION WITH THE <br />DEFENSE OF A LAWSUIT PENDING IN THE <br />DISTRICT COURT OF HAYS COUNTY, TEXAS, <br />CAUSE NUMBER 14,628, WILSON, ET. AL. V. <br />THE CITY OF SAN MARCOS, AND THE <br />PROSECUTION OF ALL CLAIMS AND CAUSES OF <br />ACTION ARISING OUT OF REPUBLIC INSURANCE <br />COMPANY I S REFUSAL fro DEFEND SAID CITY AND <br />ITS OFFICIALS IN SAID SUIT OR TO PAY <br />DAMAGES THAT MAY BE ASSESSED IN SAID <br />LITIGATION; AUTHORIZING THE CITY MANAGER <br />fro EXECUTE SAID CONTRACT; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br /> <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />desires to obtain professional legal services from Longley and <br />Maxwell, Attorneys at Law, in connection with the defense of a <br />lawsuit pending in the District Court of Hays County, Texas, and <br />the prosecution of all claims and causes of action arising out of <br />Republic Insurance Company's refusal to defend said City and its <br />officials in said suit or to pay damages that may be assessed in <br />said litigation; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the terms and conditions of a proposed <br />contract between said City and Longley and Maxwell, Attorneys at <br />Law, for the provision of professional legal serVlces in <br />connection with the defense of a lawsuit pending in the District <br />Court of Hays County, Texas, Cause Number 14,628, Wilson, et al v. <br />The City of San Marcos, and the prosecution of all claims and <br />causes of action arising out of Republic Insurance Company's <br />refusal to defend said City and its officials in said suit or to <br />pay damages that may be assessed in said litigation, a copy of <br />said contract being attached hereto and incorporated herein for <br />all purposes, are hereby in all things approved. <br /> <br />PART 2. That the City Manager, A.C. Gonzalez, be, and he is <br />hereby, authorized to execute said contract on behalf of said <br />City. <br /> <br />PART 3.
