56 ORDINANCE 1985-88 AN ORDINANCE OF 'IRE CITY COUNCIL OF TI-lE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 15 OF TI-lE CODE OF ORDINANCES OF SAID CITY BY ADDING SECTION 15-1 FEES AND CHARGES FOR LIBRARY SERVICES; SECTION 15-2, PENALTIES FOR MISUSE OF LIBRARY PROPERTY; AND BY AMENDING SECTION 15-22 BY DELETING UNNECESSARY PROVISIONS PERTAINING 10 'IRE CREATION OF THE FIRST LIBRARY BOARD, BY DELETING THE PROVISION PERTAINING 10 TI-lE TERMS OF MEMBERS AProINTED 10 FILL VACANCIES, AND BY ADDING A PROVISION PERTAINING 10 TERMS OF MEMBERS AProINTED 10 FILL UNEXPIRED TERMS; AND BY DELETING SECTION 15-23; AND RENUMBERING SECTIONS 15-24,15-25,15-26 AND 15-27 AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY 'IRE CITY COUNCIL OF 'IRE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 15-1 of Article I of Chapter 15 of the Code of Ordinances of the City of San Marcos, Texas is hereby adopted to read as follows: Sec. 15-1. Fees and charges for library services. (a) Use of the library shall be free of charge to all residents of the City of San Marcos and Hays County. ( b) A library card shall be required of each user who desires to be loaned materials and equipment. The initial library card for residents of the City and Hays County is free of charge. A replacement fee to be set each year by the library board will be charged to replace a lost card. (c) Library cards will be issued to out-of-county residents for an annual fee to be set each year by the library board. (d) Charges for lost or irreparably damaged library materials include the replacement cost of the item as determined by the library director plus a non- refundable service charge. (e) Charges for damaged library materials are determined by the library director based on the amount of time spent and materials used in repairing the item. SECTION 2. That Section 15-2 of Article I of Chapter 15 of the Code of Ordinances of the City of San Marcos, Texas is hereby adopted to read as follows: Sec. 15-2. Penalties for misuse of library property. (a) It shall be unlawful for any person to: ( 1) fail to return to the San Marcos Public Library any library material for a period longer than two (2) weeks after notice in writing is sent by the Library advising that the material is overdue. The notice shall be sent to the address noted on the current library card of the borrower. It shall be the responsibility of the card holder to nnmediately notify the library of any change of address. (2) damage in any way other than reasonable wear any materials, fixtures, furniture or structures belonging to the San Marcos Public Library. (3) take library materials out of the San Marcos Public Library without going through the prescribed check out procedure.
