<br /> 56 <br /> ORDINANCE 1985-88 <br /> AN ORDINANCE OF 'IRE CITY COUNCIL OF TI-lE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING CHAPTER 15 OF TI-lE CODE OF <br /> ORDINANCES OF SAID CITY BY ADDING SECTION 15-1 FEES AND <br /> CHARGES FOR LIBRARY SERVICES; SECTION 15-2, PENALTIES <br /> FOR MISUSE OF LIBRARY PROPERTY; AND BY AMENDING SECTION <br /> 15-22 BY DELETING UNNECESSARY PROVISIONS PERTAINING 10 <br /> 'IRE CREATION OF THE FIRST LIBRARY BOARD, BY DELETING THE <br /> PROVISION PERTAINING 10 TI-lE TERMS OF MEMBERS AProINTED <br /> 10 FILL VACANCIES, AND BY ADDING A PROVISION PERTAINING <br /> 10 TERMS OF MEMBERS AProINTED 10 FILL UNEXPIRED TERMS; <br /> AND BY DELETING SECTION 15-23; AND RENUMBERING SECTIONS <br /> 15-24,15-25,15-26 AND 15-27 AND DECLARING AN EFFECTIVE <br /> DATE. <br />BE IT ORDAINED BY 'IRE CITY COUNCIL OF 'IRE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That Section 15-1 of Article I of Chapter 15 of the <br />Code of Ordinances of the City of San Marcos, Texas is hereby adopted <br />to read as follows: <br /> Sec. 15-1. Fees and charges for library services. <br /> (a) Use of the library shall be free of charge to all <br /> residents of the City of San Marcos and Hays County. <br /> ( b) A library card shall be required of each user who <br /> desires to be loaned materials and equipment. The <br /> initial library card for residents of the City and <br /> Hays County is free of charge. A replacement fee <br /> to be set each year by the library board will be <br /> charged to replace a lost card. <br /> (c) Library cards will be issued to out-of-county <br /> residents for an annual fee to be set each year <br /> by the library board. <br /> (d) Charges for lost or irreparably damaged library <br /> materials include the replacement cost of the item <br /> as determined by the library director plus a non- <br /> refundable service charge. <br /> (e) Charges for damaged library materials are determined <br /> by the library director based on the amount of time <br /> spent and materials used in repairing the item. <br />SECTION 2. That Section 15-2 of Article I of Chapter 15 of the <br />Code of Ordinances of the City of San Marcos, Texas is hereby adopted <br />to read as follows: <br /> Sec. 15-2. Penalties for misuse of library property. <br /> (a) It shall be unlawful for any person to: <br /> ( 1) fail to return to the San Marcos Public Library <br /> any library material for a period longer than <br /> two (2) weeks after notice in writing is sent by <br /> the Library advising that the material is <br /> overdue. The notice shall be sent to the address <br /> noted on the current library card of the <br /> borrower. It shall be the responsibility of the <br /> card holder to nnmediately notify the library of <br /> any change of address. <br /> (2) damage in any way other than reasonable wear any <br /> materials, fixtures, furniture or structures <br /> belonging to the San Marcos Public Library. <br /> (3) take library materials out of the San Marcos <br /> Public Library without going through the <br /> prescribed check out procedure. <br />
