(b) A person who violates Section 15-2, of this Ordinance shall be guilty of a misdemeanor punishable by a fine of up to $200. Each day of violation for each piece of library material taken without proper check-out, damaged, or not returned after notice shall constitute a separate offense. Prosecution under this ordinance shall in no way interfere with the Library's right to collect fines or fees from the person prosecuted. SECTION 3. That Section 15-22 of Article II of Chapter 15 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to read as follows: Sec. 15-22. Terms of members. The terms of office of each member of the library board shall be three (3) years and shall begin on October first of the year of appointment. If a replacement has not been designated by the end of a member's term, then that member shall continue in the appointed position until replaced. Members appointed to fill unexpired terms with fewer than 18 months remaining in the term, may be considered for reappointment to the board to serve a full term. SECTION 4. That Section 15-23 of Article II of Chapter 15 of the Code of Ordinances of the City of San Marcos, Texas, is hereby deleted in its entirety. SECTION 5. That Sections 15-24,15-25,15-26 and 15-27 of Article II of Chapter 15 of the Code of Ordinances of the City of San Marcos, Texas are hereby renumbered as set forth hereinbelow. Section 15-24 renumbered to Section 15-23 Section 15-25 renumbered to Section 15-24 Section 15-26 renumbered to Section 15-25 Section 15-27 renumbered to Section 15-26 SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
