2 Regular Meeting November 10 1986 Page 2 PRETREATMENT OF CERTAIN INDUSTRIAL WASTES PROVIDING A SURCHARGE FOR NORMAL SEWAGE, AUTHORIZING THE DIRECTOR OF ENVIRONMENT AND EINGINEERING TO DETERMINE THE SUFFI- CIENCY OF PRETREATMENT; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND PROVISIONS OF SAN MARCOS IN CONFLICT WITH IT; PROVIDING REMEDIES; PROVIDING PENALTIES; PROVIDING FOR SEPARABILITY; AND DECLARING AN EFFECTIVE DATE. Mr. Brown moved for adoption of the Ordinance on third and final read- ing and Mr. Coddington seconded the motion. Mr. Bill Haney advised the Council he was substantially in agreement with the Ordinance with the suggested amendments before the Council at this reading except he would like to see the appeals process shortened. Mr. Coddington moved the Ordinance be amended on Page 15 (II) Procedure for hearing of Appeals in (a) to change Municipal Court to City Council and Court Clerk to City Secretary and in (c) to change Municipal Court Judge to City Council and Mr. Guerra seconded the motion. On roll call for the amendment the following vote was recorded: AYE: Brown Coddington, Younger, Guerra Nicola. NAY: Farr, Kissler. ABSTAIN: None. Ms. Kissler moved to amend the Ordinance to include the suggested amend- ments listed in Stephen Jenkins' memorandum to Mayor Younger and the Council dated November 3, 1986 as follows: Sec. 30-61(12) - Add: "Any of the following parameters may not be discharged to the extent they exceed their specified limits over a 24-hour period." Section 30-64(8) -Delete: II . other industry..." Add: "... major wastewater dischargers " . . . Add: "If a violation of this Ordinance has been shown to exist then the Director may require, for a period of three months after conditions causing the violation have been corrected, self-monitoring for those parameters of the industrial waste causing the violation to have existed." Section 30-66(1) - Add: " . . . included under Sec. 30-61 " . . . . Mr. Nicola seconded Ms. Kissler's amendment, which passed unanimously. On roll call for adoption of the Ordinance on third and final reading, the Council voted unanimous approval. Mayor Younger introduced for consideration reconsideration of a Zoning Ordinance, which the Council did not wish to reconsider. M. VERAMENDI SURVEY #2 A-17, CITY OF SAN MARCOS, HAYS COUNTY TEXAS, A SUBDIVISION IN THE CITY OF SAN MARCOS, AS SHOWN ON THE MAP OR PLAT THEREOF RECORDED IN VOLUME 4, PAGE 160, OF THE HAYS COUNTY PLAT RECORDS: A/K/A 1115 HIGHWAY 80 FROM "OP" (OFFICE PROFESSIONAL DISTRICT) TO "c" (COMMERCIAL DISTRICT); AND DECLARING AN EFFECTIVE DATE.
