<br />39 <br /> <br />Regular Meeting <br /> <br />November, 24, 1986 <br /> <br />Page 2 <br /> <br />Mr. Brown moved the Council reconvene at 9:00 p.m. and Ms. <br />Kissler seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced Item 3-3/4, an addendum to the agenda. <br />Mayor Younger introduced for consideration adoption of a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REVOKING AND RESCINDING THAT CERTAIN <br />RESOLUTION ADOPTED ON SEPTEMBER 24, 1986, AT A SPECIAL <br />MEETING OF THE SAN MARCOS CITY COUNCIL, PERTAINING <br />TO THE CREATION OF A NON-PROFIT CORPORTION WHICH WAS <br />TO BE CREATED TO OPERATE A WATER SYSTEM ACQUIRED FROH <br />ELIM WATER COMPANY, INC., AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Coddington moved for adoption of the Resolution and Ms. <br />Kissler seconded the motion. Mr. Farr moved to amend the <br />Resolution by adding the following two paragraphs to follow the <br />first paragraph beginning with "WHEREAS": "WHEREAS, at the time <br />the above Resolution was adopted, one member of the City Council <br />was absent and did not have an opportunity to express his views; <br />and," (second paragraph) "WHEREAS, after a full discussion of the <br />issues, the events which have transpired and have not transpired <br />since the adoption of the Resolution, and considering no <br />contracts have been executed or delivered by the City, the <br />Council is of the opinion that the sale and purchase is not now <br />in the public interest; now, therefore," and Mr. Coddington <br />seconded the motion, which passed unanimously. The Council then <br />voted unanimously for adoption of the Resolution. <br /> <br />Mayor Younger introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF <br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984 <br />(VOL. 66) BY ZONING 0.543 ACRES, MORE OR LESS, OF LAND <br />AREA IN THE J. M. VERAMENDI SURVEY NO. TWO, HAYS COUNTY, <br />TEXAS, BEING A PORTION OF THAT ONE ACRE TRACT OF LAND <br />CONVEYED BY DEED FROM BEN F. BOWLES, ET UX, TO ~ERALD <br />R. KELLY DATED OCTOBER 8, 1947 AND RECORDED IN VOLUME <br />139, PAGE 313 OF THE HAYS COUNTY DEED RECORDS, AND AP- <br />PARENTLY BEING ALL OF THAT 0.552 ACRE TRACT CONVEYED <br />BY DEED FROM ROBERT GARRETT TO GEORGE CHRIST DATED <br />JUNE 17, 1982 AND RECORDED IN VOLUME 376, PAGE 706 OF <br />THE HAYS COUNTY DEED RECORDS; LOCATED IN THE 1100 BLOCK <br />OF HIGHWAY 80 FROM "PD" (PRE-DEVELOPMENT DISTRICT) TO <br />"C" (COMMERCIAL DISTRICT); AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Younger opened the public hearing and asked if anyone <br />wished to speak in favor or in opposition to the zoning change. <br />No one did, so Mayor Younger closed the public hearing. Ms. <br />Kissler moved for adoption of the Zoning Ordinance and Mr. Farr <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 2-43 OF DIVISION 2 <br />ENTITLED "TEXAS I-IUNICIPAL RETIREMENT SYSTEM" OF <br />ARTICLE III, ENTITLED "CIVIL SERVICE AND EMPLOYEE <br />BENEFITS" OF CHAPTER 2 OF THE CODE OF ORDINANCES OF <br />SAID CITY TO CHANGE THE DATE ON WHICH CALCULATIONS OF <br />UPDATED SERVICE CREDITS ARE BASED, UNDER THE ACT <br />
