<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, 'Texas, which is presently zoned
<br />"P" (Public Use District) henceforth shall be rezoned "DP-2"
<br />(Duplex District).

<br />aUT OF THE T.J. CHAMBERS SURVEY, HAYS COUNTY, TEXAS, BEING
<br />ALL OF THAT TRACT CONVEYED BY W. E. EZELL AND LOTTIE EZELL 10
<br />JIM BRYANT BY THAT DEED DATED 20 FEBRUARY 1912, FILED 20
<br />FEBRUARY 1912, AND RECORDED 23 FEBRUARY 1912 IN VDWME 61,
<br />PAGES 385-386 OF THE DEED RECORDS OF SAID COUNTY, AND LYING
<br />WITHIN LOT 4 OF 'IRE DIVISION OF 'IRE G. B. EZELL ESTATE,
<br />THE PLAT OF WHICH IS RECORDED IN VDWME 53, PAGE 8 OF 'IRE SAID
<br />DEED RECORDS.

<br />This parcel is shown on a plat of a survey dated 14 March 1985
<br />by Charles R. Swart, Surveyor, and is more particularly
<br />described by metes and bounds in the following paragraphs. The
<br />aluminum capped iron monument cited is a 5/8 inch diameter iron
<br />bar, 24 inches long, with a 1 1/2 inch diameter aluminum cap
<br />marked

<br />Beginning at the east corner of this 0.3209 acre parcel, which
<br />is identical with the east corner of the said Bryant tract, and
<br />is marked with an aluminum capped iron monument (point 15); this
<br />point, which is on the northeast line of said Lot 4, bears North
<br />45 degrees 30.0 minutes v~st a distance of 11.39 feet from the
<br />east corner of said Lot 4, which is marked with a 1/2 inch I.D.
<br />iron pipe.
<br />
<br />Thence, from the point of beginning, South 59 degrees 00.0
<br />minutes West along the southeast line of this parcel a distance
<br />of 106.86 feet to the south corner of this parcel, which is
<br />identical with the east corner of that tract conveyed by G.B.
<br />Ezell to Jake Peidler by that deed dated 13 November 1895, filed
<br />7 July 1896, and recorded 7 July 1896 in Volume 33, page 203 of
<br />the said deed records, and is marked with an aluminum capped
<br />iron monument (point 18);

<br />Thence, from the south corner of this parcel, North 30 degrees
<br />00.0 minutes West along the northeast line of the said Peidler
<br />tract and the northeast line of a second tract conveyed by G.B.
<br />Ezell to Jake Peidler by that deed dated 20 November 1899, filed
