<br /> XIII. <br /> Flight Operations shall not make nor enter into any <br /> contract, order or obligation of any kind in the name of or <br /> in behalf of City, and no contractual or other obligation entered <br /> into by it shall be binding upon City without the previous written <br /> authorization of City. <br /> XIV. <br /> Flight Operations agrees to file with City a policy of <br /> public liability insurance issued by a casualty insurance company <br /> duly authorized to do business in the State of Texas with minimum <br /> limits of $100,000.00 per person and $300,000.00 for any single <br /> occurrence of bodily injury or death and $100,000.00 for any single <br /> occurrence of injury to or destruction of property. Said insurance <br /> policy shall name City as co-insured. Said insurance shall contain <br /> the endorsement that such insurance may not be cancelled or amended <br /> with respect to Flight Operations without ten (10) days written <br /> notice by certified mail, return receipt requested, to City by the <br /> insurance company. City shall not be required to pay any of the <br /> premiums for said policy. Any insurance policy herein required or <br /> procured by Flight Operations shall contain an express waiver of <br /> any rights of subrogation by the insurance company against City. A <br /> copy of any policy so procured shall be delivered by Flight Operations <br /> to City within ten (10) days of the execution of this agreement and, <br /> thereafter, within ten (10) days of the inception of any policy by <br /> the insurance company. The minimum limits of any insurance coverage <br /> herein required shall not limit Flight Operations liability under <br /> Part XV of this agreement. <br /> XV. <br /> Flight Operations agrees to indemnify and hold harmless City <br /> from all damages, claims, losses, demands, suits, judgments, costs <br /> and expenses arising from the conduct by Flight Operations of a FBO <br /> operation at Airport and shall defend any litigation arising in <br /> connection with such operation including reasonable attorneys' fees <br /> 5 <br />
