<br /> X. <br /> Flight Operations will provide for the sale of gasoline during <br /> the term of this lease agreement. For this purpose, Flight <br /> Operations shall have the use and custody of, and is hereby delegated <br /> the control over the gasoline storage tanks located adjacent to <br /> Hanger Building No. 5-357 and any fuel dispensing equipment attached <br /> thereto. <br /> XI. <br /> Commencing on the date of execution of this lease agreement <br /> by Flight Operations, and during the term of this lease agreement, <br /> Flight Operations shall be entitled to all of the proceeds received <br /> by it from the services and facilities performed and furnished <br /> hereunder, and Flight Operations shall pay to City the following <br /> items of consideration: <br /> 1. During the first two (2) years of this agreement, <br /> Flight Operations shall pay the sum of $.02 per <br /> square foot per year, payment to be made in advance <br /> and on each anniversary date of this lease. <br /> 2. For the remaining period this lease is in effect, <br /> Flight Operations shall pay the sum of $.05 <br /> per square foot. <br /> 3. A sum of money equal to one percent (1%) of <br /> the gross sales of gasoline or other aircraft <br /> fuel pumped or sold at Airport shall be paid <br /> from the date of execution of this agreement <br /> by Flight Operations. <br /> Such items of consideration accruing during each calendar <br /> month of this agreement shall be paid by Flight Operations to City <br /> at City's office in Hays County, Texas, and shall be due and payable <br /> not later than the tenth (10th) day of the following month. <br /> Notwithstanding the foregoing it is understood that the fuel <br /> for which City shall receive a percentage as provided in (3) above <br /> shall include fuel used by Flight Operations, whether or not sold, <br /> based on delivery receipt from the fuel supplier. <br /> XII. <br /> Flight Operations agrees to pay all utility charges in connection <br /> with the premises occupied and used by Flight Operations at Airport <br /> for which City becomes liable. <br /> 4 <br />
