H. 35 North <br /> San Marcos, Texas 78666 <br /> To Charlotte anå Wayland Endsley: <br /> This letter shall serve as the agreement between Charlotte <br /> and Wayland Endsley, hereinafter called "Benefactors" and the <br /> City of San Marcos, Texas, hereinafter called "City", <br /> authorizing Benefactors to place a driveway on City <br /> right-of-way. The driveway will be on Meiners Street <br /> covering forty (40) feet beginning from Thorpe Lane. <br /> The following provisions are understood by all parties: <br /> 1. The City shall not share in any way in the <br /> costs of preparing, constructing or paving the <br /> driveway; <br /> 2. The City reserves the right to use the <br /> right-of-way, including the area subject to <br /> this agreement, at any time and in any way the <br /> City deems desirable; <br /> 3. Should any use, condition, or circumstance <br /> cause destruction or disrepair of any part or <br /> all of the improvements placed in such <br /> right-of-way, the City shall not be liable for <br /> any construction, reconstruction, repair, or <br /> any other expense or claim which may result <br /> therefrom; <br /> 4.
