Benefactors and/or any and all agents, <br /> servants, employees, representatives, assigns, <br /> successors, invitees, known or unknown of said <br /> Benefactors, RELEASE, DISCHARGE, INDEMNIFY, <br /> and HOLD HARMLESS the City, its agents, <br /> servants, employees, representatives, <br /> officers, directors, assigns, insurers, <br /> successors, and any and all other parties in <br /> privity, corporate or otherwise, from any and <br /> all liability whatsoever, resulting from the <br /> use and/or arising from the use or attempted <br /> use of the driveway by Benefactors or any <br /> other persons. <br /> It is expressly understood and agreed that the <br /> terms herein are contractual and that said <br /> Benefactors shall indemnify the City against <br /> all damages, claims, losses, demands, suits, <br /> judgments, costs and expenses arising in <br /> connection with the said use by the said <br /> Benefactors or other persons and in addition, <br /> said Benefactors shall defend any litigation <br /> arising from or in connection with the said <br /> use, including payment of any and all <br /> reasonable attorneys' fees.
