<br />64 <br /> <br />Regular Meeting <br /> <br />December 8,1986 <br /> <br />Page 3 <br /> <br />with the Rules and Regulations with an appeals process to the Council. <br />Mr. Coddington stated he thought the Electric System needed to be <br />operated on a day-to-day basis by a General Manager. Austin Curlee <br />stated the Utility Board now has a consultant, Fred Saffer, to advise <br />them. Mr. Curlee feels LCRA is presently competent to run the system <br />and that a General Manager is not needed at this time. Mr. Gonzalez <br />stated Mr. Saffer's role is to conduct studies and that he thinks a <br />General Manager would be overdoing what is needed at this time. He <br />stated the City needs to set up a person in the Finance Department to <br />take on a needed role. Mr. Curlee also stated Mr. Saffer has sixty <br />days to consummate his projects. The Council expressed an interest <br />in the Utility Board advising the Council if a General Manager is <br />needed. Mr. Brown asked Mr. Hankins if Council Members had a right to <br />the appeals process. Mr. Hankins stated the Council has a right to <br />appeal and be represented by someone else. In response to Ms. Kissler's <br />questions, Mr. Eankins stated the Ordinance is set up to provide flexi- <br />bility to the Board with the appeals process and that he is not sure <br />thirty days is sufficient time to appeal but that the Council can change <br />this if they so desire. He stated what is important to be included in <br />the Ordinance is that adequate notice be provided and that citizens <br />have a right to appeal. Ms. Kissler stated maybe sixty days would be <br />a more reasonable time frame for the appeals process. Mr. Coddington <br />moved to amend the Ordinance in Section 9-1/2-2. (b) to change the days <br />of publications from fifteen and one to twenty-two and eight; in Section <br />9-1/2-2. (f) to read II . . . subject to a written appeal by any rate <br />payer after they have been adopted. . . ."; in Section 9-1/2-3. (b) to <br />change the days of publications from fifteen and one to twenty-two and <br />eight; and in Section 9-1/2-3. (f) to read II . . . subject to a written <br />appeal by any rate payer after they have been adopted. . . .", and Mr. <br />Farr seconded the motion, which passed unanimously. On roll call for <br />approval of the Ordinance on first reading, the Council voted unanimous <br />approval. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance on <br />first reading, the c~ption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SEWAGE SYSTEM CAPITAL <br />RECOVERY FEE ORDINANCE AND THE WATER SYSTEM CAPITAL <br />RECOVERY FEE ORDINANCE BY PROVIDING AN EXEMPTION FOR <br />LOCAL TAXING UNITS AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mayor Younger seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE GRANTING THE AUTHORITY, RIGHT AND <br />PRIVILEGE TO OPERATE AND MAINTAIN A SATELLITE <br />MASTER ANTENNA TELEVISION SIGNAL DISTRIBUTION <br />SERVICE FOR THE DISTRIBUTION OF AUDIO, VIDEO AND <br />RADIO SIGNALS, PROVIDING THE TERMS AND PROVISIONS <br />UNDER WHICH SAID SYSTEM SHALL BE OPERATED AND MAIN- <br />TAINED, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Coddington moved to approve the Ordinance on first reading and Ms. <br />Kissler seconded the motion. Mr. Hankins advised the Council this Ordin- <br />ance only pertains to cable service being provided to the Village Green <br />Apartments. The Council voted unanimously for approval of the Ordinance <br />on first reading. <br />
