<br /> AN ORDINANCE OF THE CITY COUl'~I L OF THE CITY OF SAN
<br /> MARCOS, TEXAS, ABANOONING AND VACATING A EORTION OF
<br /> ANALLEY IN THE J. S. 'TRAVIS ADDITION 'IO THE CITY OF
<br /> SAN MARCOS, TEXAS; AU'IRORIZING 'IRE MAYOR OF SAID CITY 'IO
<br /> EXECUTE SPECIAL WARRANTY DEEDS; REFLECTING PAYMENT OF
<br /> THE FAIR MARKET VALUE OF $890.00; PROVIDING FDR THE
<br /> REVERSION OF TITLE 'IO SAID PROPERTY AND THE RETENTION OF
<br /> EASEMENTS; AND DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, an alley in the J.S. Travis Addition To The City Of
<br /> S:m Marcos, the plat of said subdivision recorded in Volume 0,
<br /> 203, of the Hays County Deed Records, and being that alley
<br /> runs in a northwesterly and southeasterly direction and which
<br /> the northeastern boundary lines of Lots 3,5,6,7, and 8, and
<br /> southwestern boundary lines of Lots 2, 10, 11, 12 and 13, was
<br /> lS dedicated to public use on the plat of the J. S.
<br /> Add i tion 1b The City of San Marcos of record in Volume 0, Page
<br /> of the Deed Records of Hays County, Texas; and,
<br /> WHEREAS, the City of San Marcos has been requested by San Marcos
<br /> Telephone Company, Inc. to abandon said portion of said alley; and,
<br /> WHEREAS, the City of San Marcos has duly determined that
<br /> Realcom, Inc. and Tuttle Lumber Company are the sole owners of
<br /> all property abutting said portion of said alley which is proposed
<br /> to be abandoned; and;
<br /> WHEREAS, the City Council of the City of San Marcos, Texas, has
<br /> determined that it is in the public interest to abandon said
<br /> portion of said alley so long as a 15 foot wide easement is
<br /> retained for the maintenance of a sanitary sewer line presently
<br /> located within a portion of said alley, and for the maintenance
<br /> of a sanitary sewer line to be installed and constructed by Realcom,
<br /> Inc. on, over and across Lot 7 as shown on the plat of the said
<br /> J. S. Travis Addition, or on, over and across that property in the said
<br /> J.S. Travis Addition upon which said sewer line is installed and
<br /> constructed (7 1/2 feet on either side of said sewer lines for
<br /> maintenance purposes); and,
<br /> WHEREAS, the owners of all land abutting said
<br /> portion of said alley have executed releases discharging said City from
<br /> any damages occasioned by said vacation and abandonment; and,
<br /> WHEREAS, the City of San Marcos has determined by appraisal that
<br /> the fair market value of its interest in said property is $890.00 and
<br /> the same has previously been deposited with said City; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1: That that alley located in the J.S. Travis Addition
<br /> 1b The City Of San Marcos, the plat of said subdivision being
<br /> recorded in Volume 0, Page 203 of the Deed Records of Hays
<br /> Coun ty, Texas, said alley being that alley which runs ln a
<br /> northwesterly and southeasterly direction and which abuts the
<br /> northeastern boundary lines of Lots 3,5, 6, 7 and 8 and the
<br /> southwestern boundary lines of Lots 2,10,11,12 and 13; less and
<br /> except the following described portion of said alley which abuts a
<br /> portion of Lots 2 and 3 which was previously abandoned, vacated and
<br /> closed by said City on January 30,1967:
<br /> Being a portion of land out of Block No.2, J.S. Travis Addition
<br /> to the City of San Marcos, Hays County, Texas, said subdivision
<br /> being of record in Volume 0, Page 203, Hays County Deeds Records
<br /> and:
