<br /> BEGINNING at a concrete monument found at the intersection of
<br /> the East line of a public alleyway and the South line of Comal
<br /> Street as recognized and used upon the ground, for the Northeast
<br /> corner of the tract herein described, and from which beginning
<br /> corner, a concrete monument found at the intersection of the
<br /> South line of Camal Street and the V\est line of Guadalupe Street
<br /> as recognized and used upon the ground, for the Northeast corner
<br /> of said Block #2, J.S. Travis Addition, bears N 82 05'E,158.33
<br /> feet;
<br /> THENCE with the said South line of Comal Street, S 81 34'w,
<br /> 20.38 feet to an iron stake set on the west line of said public
<br /> alleyway as recognized and used upon the ground, for the
<br /> Northwest corner of the tract herein described;
<br /> THENCE leaving Coma 1 Street with the west line of said public
<br /> alleyway, S 7 38'E, 101.67 feet to an iron stake set for the
<br /> Southwest corner of the tract herein described;
<br /> THENCE leaving the V\est line of said public alleyway, N 81 34'E,
<br /> 21.03 feet to a steel post in woven wire fence on the East line
<br /> of said public alleyway as recognized and used upon the ground,
<br /> for the Southeast corner of the tract herein described;
<br /> THENCE with the East line of said public alleyway, N 8 00 'w,
<br /> 101.67 feet to the place of beginning, containing 2105 sq. ft.
<br /> of land,
<br /> be, and it is hereby declared to be, and is henceforth vacated and
<br /> abandoned to Realcom, Inc. and Tuttle Lumber Company, and said alley
<br /> is hereby abandoned as to any use, right or claim in or responsibility
<br /> for the upkeep and maintenance by the public in general and the City
<br /> of San Marcos in particular, except that a 15 foot wide sanitary sewer
<br /> line easement to said City is hereby expressly retained for said
<br /> City's maintenance of a sanitary sewer line presently located in
<br /> said alley and, as part of the consideration for this transaction,
<br /> Realcom, Inc. shall give the City of San Marcos an easement and
<br /> shall obtain easements to said City from all other necessary
<br /> owners for the maintenance of a sewer line to be installed and
<br /> constructed by Realcom, Inc. on, over and across IDt 7 as shown on the
<br /> plat of the said J.S. Travis Addition, or on, over and across that
<br /> property In the J .S. Travis Addition upon which said sewer line is
<br /> installed and constructed (7 1/2 feet on either side of said sewer
<br /> lines for maintenance purposes).
<br /> SECTION 2. That the Mayor of the City of San Marcos, Texas, be,
<br /> and she is hereby, authorized to execute special warranty deeds to
<br /> Realcom, Inc. and Tuttle I..umbe r Company conveying to each
<br /> one-half (1/2) of the width of said portion of said alley which abuts
<br /> their respective properties following said City's acceptance of the
<br /> sewer line to be installed and constructed by Realcom, Inc.
<br /> and the granting to said City of easements by the necessary property
<br /> owners for maintenance of said sanitary sewer line as set forth in
<br /> Section 1 hereof or upon submission of security in the amount of $5,700
<br /> to said City which represents one and one-half (1/2) times the
<br /> estimated cost of installation and construction of the sewer line
<br /> provided for in Section 1 hereof. The form of said security
<br /> shall be as approved by the City Attorney.
<br /> SECTION 3. That this Ordinance shall be in effect ten (10) days
<br /> from and after its passage and after the acceptance by said City of the
<br /> sewer line to be installed and constructed by Realcom, Inc. and
<br /> the granting to said City of easements by the necessary property owners
<br /> for maintenance of said sanitary sewer line as set forth in Section 1
<br /> hereof or the submission of approved security as provided in Section 2
<br /> hereof, whichever last occurs, and it shall be published in a newspaper
<br /> of general circulation in the area as required by the Charter of the
<br /> Ci ty of San Marcos, Texas.
