<br /> a reduction in the overall density or intensity of the <br /> development shown on the Land Plan unless the parties hereto <br /> agree otherwise. The City agrees to exempt Developer from any <br /> amendment to the Subdivision Ordinance which would mandate such a <br /> reduction. <br /> C. Developer agrees that the City shall have the right <br /> to review plans for and may at any time during construction <br /> inspect water, sewer or drainage facilities and roads within the <br /> District, and commercial or industrial buildings and other <br /> structures. In addition, the City shall have the right to <br /> charge, and the Developer agrees to require the builders to pay, <br /> the in-city plan review and inspection fees for review of site <br /> preparation and all buildings and facilities under construction. <br /> The City shall have the right to inspect or to have an <br /> independent consultant inspect site preparation and construction <br /> of buildings on property within the District. Provided, however, <br /> in the event the City or its independent consultant is unable to <br /> perform such inspections within two (2) working days of a request <br /> for inspection by that property representative, approval of such <br /> particular facets of construction for which inspection was <br /> requested shall be deemed to have been given by the City. <br /> D. Developer or its successors or assigns shall submit <br /> a site plan for any land to be developed within the District <br /> other than for single family or duplex structures. Said site <br /> plan shall be in conformance with the then current City Master <br /> Plan, Zoning Ordinance, Interim Drainage and Erosion Control <br /> Ordinance, and Landscape and Buffer Ordinance. In addition, said <br /> site plan shall be submitted to Developer's Architectural Control <br /> Committee prior to any construction on the land included on the <br /> site plan. Developer agrees to submit a subdivision master plan <br /> for the entire District to the City. Developer shall appoint the <br /> City's Planning Director or his designee to serve as a permanent <br /> member on the Developer's Architectural Control Committee. <br /> -23- <br />
