<br /> E. Developer agrees to dedicate a one-half <1/2) acre <br /> site within the District as shown on the Land Plan to the <br /> District for a Fire Station. Such land shall be dedicated no <br /> later than the date of disbursement of the proceeds of the first <br /> sale of bonds by the District. <br /> Developer shall make available to the District Two <br /> Hundred Fifty Thousand Dollars ($250,000.00) for the construction <br /> of a Fire station on the site and the purchase of a class "A" <br /> pumper truck and appurtenances; provided, however, if the <br /> construction costs of said station and equipment in accordance <br /> with the plans and specifications approved by the City are less <br /> than ($250,000.00), Developer shall be required to contribute <br /> only the lesser amount. In the event the District is not <br /> authorized pursuant to Ch. 50 of the Texas Water Code to provide <br /> fire protection services and construct and operate the facilities <br /> provided in this section, then the amounts specified will be paid <br /> directly to the City. It is the intent of Developer and <br /> understanding of the City that such purchase is to benefit the <br /> area \vi thin the District. It is agreed that these costs are a <br /> reimburseable expense of the District under the terms of Chapter <br /> 50 of the Texas Water Code and any requests for such <br /> reimbursement will not be prohibited or limited by the City. The <br /> Developer shall make the $250,000.00 available for funding of the <br /> Fire station and purchase of the pumper truck within three (3) <br /> years of the election confirming the creation of the District or <br /> upon connection to the water and wastewater systems of this <br /> District and Hays County MUD No. 3, taken and added together, of <br /> the SOOth living unit equivalent, whichever occurs first. <br /> F. Developer agrees to reserve for up to five (5) years <br /> from the date of this Agreement a ten <10) acre site within the <br /> District for acceptance and purchase by the Hays LS.D. at a cost <br /> of Twenty-one Thousand Five Hundred Dollars ($21,500.00) per <br /> acre. <br /> -24- <br />
