<br /> G. Developer agrees to dedicate to the District fifteen <br /> (15) acres of parkland within the District as shown on the Land <br /> Plan to the District within one (1) year of the election for <br /> confirmation of the creation of the District with provision that <br /> such land and any improvements thereon transfer to the City upon <br /> annexation of such district. <br /> H. Developer agrees to landscape, provide other <br /> improvements and maintain or have maintained such improvements to <br /> the dedicated parkland until City annexation. Developer agrees <br /> to construct or acquire park and other recreational facilities <br /> for parkland within the District. Such facilities shall be of a <br /> total value of at least $600,000.00 and shall be constructed or <br /> acquired and installed no later than five ( 5) years after the <br /> date of the election confirming the creation of the District or <br /> upon connection of the SOOth living unit equivalent, whichever <br /> occurs first. Such facilities shall be donated to the District <br /> without cost to the District after construction or acquisition of <br /> the facilities. Plans for installation of facilities and <br /> maintenance of parkland and facilities shall be presented to the <br /> City for approval prior to the confirmation election of the <br /> District and shall be incorporated into the Subdivision Master <br /> Plan for the property in accordance with the Subdivision <br /> Ordinance. <br /> 1. Developer agrees to dedicate rights-of-way or <br /> easements for roadways within the District consistent with the <br /> conditions met by all similarly situated properties along the <br /> selected route or routes. <br /> J. Developer, the City and the District acknowledge and <br /> agree that it is in the best interest of the residents and <br /> inhabitants of the District to obtain the level of fire <br /> protection services in the District that will provide to the <br /> property in the District the fire insurance benefits of the <br /> City's key rating by the State Board of Insurance. The parties <br /> further acknowledge that fire protection services provided by the <br /> -25- <br />
