<br /> City to the District and other areas in the region would <br /> accomplish that objective. Accordingly, the City agrees to <br /> cooperate with the District in developing a method for the City <br /> to provide or assist in providing fire protection services in the <br /> District pursuant to the provisions of the Texas Water Code and <br /> the Interlocal Cooperation Act, Art. 4413 (32c), V.T.C.S. The <br /> District agrees to seek authorization to contract with the City <br /> for the City to provide or assist in providing fire protection <br /> services in the District and to initiate proceedings to obtain <br /> such authorization as soon as possible after creation of the <br /> District is approved by the Texas Water Commission. The parties <br /> agree that pending the development of the plan between the <br /> District and the City for the property in the District, such <br /> services may be provided on an interim basis by another entity. <br /> K. Developer may apply for or assist in applying for a <br /> water transport permit from the Edwards Underground Water <br /> District for water to be supplied to the District. Developer <br /> agrees that should the District be created with water service to <br /> be provided by the City, that such permit, if received, shall be <br /> an asset of the District which would transfer to the City upon <br /> annexation or at such time as City requires such permit to serve <br /> the area within the District. <br /> L. Developer agrees to donate to the appropriate <br /> governmental agency Twenty-five Thousand Dollars ($25,000.00) <br /> towards the construction of a bridge or overpass over IH-35 near <br /> or adjacent to the District, at the time of funding for <br /> construction. <br /> M. Any failure on the part of Developer or its <br /> successors or assigns to obtain the required permits, approvals, <br /> inspections, or pay the required fees to the City shall subject <br /> Developer or its successors or assigns to stop-orders requiring <br /> the cessation of any further construction or related operations <br /> until such payments, permits, reviews, approval, or inspections <br /> are acquired or completed. <br /> -26- <br />
