<br /> N. Developer covenants and agrees that, within thirty <br /> ( 30) days following the election confirming the creation of the <br /> District or prior to any platting within the District, whichever <br /> occurs first, it will file a set of restrictive covenants or deed <br /> restrictions in the Deed Records of Hays County, in a form <br /> approved by the City Attorney, to ensure compliance with the <br /> provisions of A.rticle IX of this Agreement. Such covenants and <br /> restrictions shall run with the land and be binding upon <br /> Developer and all successors and assigns until dissolution of the <br /> District or for forty (40) years, whichever comes first. <br /> Construction on the property within the District shall be in <br /> compliance with such covenants and restrictions which shall <br /> include, but not be limited to (1) requiring that the standards <br /> set forth in the City's building codes, including but not limited <br /> to the Building Code, Plumbing Code, Air Conditioning/Heating <br /> Code, Electrical Code, Fire Code and Gas Code as they exist and <br /> as they may be amended from time to time, be met, (2) requiring <br /> compliance with the standards and criteria set forth in the <br /> City's Subdivision Ordinance and Zoning Ordinance for applicable <br /> land uses as shown on the Land Plan, and (3) requiring compliance <br /> with the Landscape Ordinance and Interim Drainage and Erosion <br /> Control Ordinance as they may be amended from time to time. <br /> In addition, such covenants and restrictions shall put <br /> builders or developers within the District on notice that (1) <br /> they will be required to pay the in-city plan review and <br /> inspection fees for review of all buildings planned or under <br /> construction, and ( 2) any failure on the part of builders or <br /> developers to obtain the required '.¡- approvals, <br /> perml~s, <br /> inspections, or pay the required fees to the City shall subject <br /> the builder or developer to stop-orders requiring the cessation <br /> of any further construction or related operations until such <br /> payments, permits, reviews, approvals, or inspections are <br /> acquired or completed. <br /> -27- <br />
