Further, the covenants and restrictions shall put the owners of all cable TV systems to be operated within the District on notice that they are required to provide the City of San Marcos with all information which would normally be required by the City to complete a franchise agreement. Such information is to be initially submitted at least thirty ( 30) days before operations are scheduled to begin within the District, and updated from time to time as changes occur. The covenants and restrictions may state that such owners are not required to make payment to the City of any fees or charges incident to the operation of any such cable TV system prior to annexation of the District by the City. Developer hereby makes a non-exclusive assignment of its right to enforce these covenants and restrictions to the City. Such assignment to the City shall not prevent Developer from also enforcing such covenants and restrictions. O. Developer agrees to participate in an affordable housing plan for low income families and individuals which the City may develop in the future, and amend from time to time, with such plan to also be applied within the City and within its ETJ to the extent authorized by law. P.
