<br /> Water Commission for permission to issue District bonds, the <br /> District shall, at the same time, file with the City Manager of <br /> the City or his designee a copy of the engineering report and any <br /> other documents indicating the bonding authority being sought. <br /> Appropriate City staff shall review such documents for compliance <br /> with this Agreement, the engineering report submitted in support <br /> of the bond application and other related documents on file with <br /> the City. <br /> ARTICLE III <br /> WATER, WASTEWATER AND DRAINAGE FACILITIES <br /> A. It is understood and acknowledged that the City <br /> through an agreement with Developer or the District, as <br /> appropriate, will provide water and sewer service to the property <br /> within the District through the use of facilities to be <br /> constructed in accordance with the North San Marcos Service Area <br /> Plan (the "Regional facilities"), a copy of which is attached <br /> hereto as Exhibit "CII and incorporated herein by reference <br /> ("Service Plan"). At the times and in the manner requested by <br /> Developer or District, as appropriate, the City agrees to sell <br /> and deliver to the property within the District all water which <br /> may reasonably be required for domestic and commercial purposes <br /> by users within the District, and to collect, transport and treat <br /> the wastewater generated by the development within the District. <br /> City agrees that it has the responsibility and obligation to <br /> apply for and acquire the wastewater discharge permit required to <br /> carry out the intent of this Agreement. City further agrees to <br /> operate and maintain the water and waste\vater facilities, both <br /> within and outside the District, in accordance with all local, <br /> state and federal statutory and regulatory requirements and <br /> standards. <br /> It is understood and acknowledged by the parties that <br /> the City has granted consent to creation of four ( 4) municipal <br /> utility districts to be located generally north of the City's <br /> corporate limits and within its extraterritorial jurisdiction. <br /> -4- <br />
