<br /> It is further understood and acknowledged that the City and the <br /> developers of the four ( 4) districts have agreed to construct <br /> certain Regional water and wastewater facilities, in accordance <br /> with the Service Plan, which together will connect to and become <br /> a part of the City's water and wastewater utility systems. <br /> Developers of each district have also agreed, with the City's <br /> consent, to construct the Regional facilities to provide service <br /> to the four districts and provide additional service capabilities <br /> for areas outside of the districts within the City's <br /> extraterritorial jurisdiction or utility service area. <br /> Developer or the District shall also cause to be <br /> designed and constructed any internal wastewater collection or <br /> water distribution systems in accordance with the plans prepared <br /> by the engineer for Developer or the District, which plans shall <br /> meet the standards, specifications and utility service plan of <br /> the Citv for similar facilities. Construction of any facility <br /> ., <br /> shall not commence unless the plans and specifications therefor <br /> have been approved by all governmental entities having <br /> jurisdiction. Provided, however, the District and/or Developer <br /> shall have the right to impose specifications and requirements <br /> for construction and installation which exceed or are more <br /> restrictive than those established by the governmental agencies. <br /> It is understood and agreed that Developer or District <br /> may contract with Maxwell Water Supply Corporation for water <br /> service to property within the District, on an interim basis, <br /> until such time as the City has the facilities, capacity and <br /> capability to provide such service pursuant to the terms of this <br /> Agreement. It is anticipated that this connection will remain to <br /> facilitate emergency backup between Maxwell and the regional <br /> system. Such emergency backup shall be allowed with the <br /> understanding that this backup shall not replace that capacity in <br /> the Regional facilities which Developer or its successors has <br /> committed to purchase and reserve. The cost of facilities <br /> necessary to provide service to the District from Maxwell shall <br /> -5- <br />
